Cheers Pixie...... after doing much hunting round the house this morning found lots of paperwork to do with Link and a few wee bits and pieces regarding Instant Silver who has obviously contacted us before for these two accounts....been on the go for sometime long before we were knidly guided and helped by AAD.

My Family says I was like a caged lion in hospital, was realy worried how Hubby was coping although our Daughters are a great help, so boring being in hospital epecially when you can't get up and move around.

On the mend now each day getting better and better can't be ill for too long, Hubby needs me, so up and onwards as they say....

        Dear Sirs,

        Ref: xxxxxxxx

I write with reference to your letter dated xx/xx/2013 and note the content within.

I must at this point refer you to my last letter, sent to your parent company DLC (copy attached), and request you take note of the content and stop harassing me. I have told you several times before that my husband is extremely ill. You have NO right to visit when I am already communicating with you. If you do visit then you will ultimately be responsible for anything that may occur - you have no need to visit me. If you write, I will reply to you like I have with ALL letters to date. The OFT agree with my stance, and thus my formal response to your letter is quite simply, get lost!

You are not licenced to conduct this business and a report has now been sent to the OFT regards your blatant abuse of process and licensable activity.

You may now treat this as a formal complaint. Do not visit me at my home address, never. If you do then there will be serious consequences for the person visiting as well as swift legal action against you.

Finally, may I refer you to the main context of Arkell v Pressdram. Please do familiarise yourself with it, as that is the response you will get if you write to me again.

        Yours faithfully,

Got the response on Saturday (sorry couldn’t get on here any earlier lots of problems at this end to deal with just now, my Hubby not good and few other dilemmas affecting our family just now). I have typed out their response below, I don’t know how to scan (sorry)…..

Niddy said this was UE last year as they only sent me application form, however a few weeks ago they sent me same application form but this time with T & C's at that particular time there was mega things going on with AAD so tried not to bother Niddy to much, maybe try and resend copies for his professional advice...

This company now starting to p*** me off now, I have too many other personal problems going on just now, so god help the field agent that does turn up at our door.

        Dear xxxxxx

We refer to your complaint letter dated xxxx addressed to Mercantile Data Bureau (MDB). This has been passed on to Hillesden Securities Ltd T/A direct legal & collections to respond.

        Complaint details (summary)

Our understanding of your complaint is that you wish for MDB to stop harassing you. You state that you are in communication in regards to the outstanding balance and there is no need for a visit to your property. You state that MDB are not licensed and a report has been sent to the Office of Fair Trading.

        · The last communication from you was July 2013 (THIS IS NOT TRUE) therefore we disagree with your comments that you are in communications with our company of MDB.
        · Due to the above point, we deny that any harassment has taken place within the meaning of section 1 of the Protection from Harassment Act 1997 or under section 40 of the Administration of Justice Act 1970. It is entirely reasonable for us, as the creditor, to communicate directly with the customer in relation to the repayment of an agreement entered into, especially where the customer is not legally represented we do communicate with the solicitors directly.

        · The balance of xxxx is correct and due. We would request you contact MDB to discuss the repayment options to you.

        Summary

Further to the above, your complaint has not been upheld and your account will remain with MDB for collections activity to continue.

We trust this now resolves the matter. Please confirm this by return wither in writing or by telephoning our offices by 14 October 2013.
Niddy advise us to ignore this letter...

Now received another letter from Dlc stating:-

If you are dissatisfied with the outcome of your inquiry you may refer to the FOS. You must do this within 6 months of the date of this letter. A leaflet explaining how you can raise this matter with the FOS is enclosed for your information.

You may also refer this to the Credit Services Association as the addres below.

        Yours Sin/

Bloody DLC are a pest!! Don't worry, if they do send a doorstep collector just play it cool and tell him your doorstep is not for sale and to leave prior to you reporting him to the Police for harassment, then walk away/ignore anything else (ie shut your door and walk away)

regards Link, likewise don't worry too much about them, this is SB all the way now, and a year for good luck I&E so just keep ignoring them until they make threats in which case THEN send in the SB (Scotland) template.

You're doing fine here - take some time out now to enjoy for yourself..... I hope you're feeling better now? Pass my wishes to hubby

                  Hi Folks..

Wee update..Please bear with me as finding this hard to write..Not been on here as much as usual (just reading posts)not been in a good place lately, suffering from Depression, Anxiety, Panic Attacks and poor concentration, came on all of a sudden at Xmas but didnt really understand what was happening to me (Wasn't long out of hospital after surgery and thought it had something to do with that). Finding it very hard to cope with at the moment.

Hubby (mr M) not in good health at moment (lots of things going on) and our eldest Daughter who has been getting treated for headaches with Ibruprofen and Paracemtamel collapsed again and taking into hospital she needed fluid drained off her brain, too much pressure waiting for Neurologist report.

As for DLC they have sent us two letters over the Xmas period offering us discounts but to be hones I just ignored them (hope havent ruined all Niddys hard work) everything just seems so muddled up in my brain even more than ever at this present time. Been put on medication but not sure how long it takes to help.

they would be mailshots to be honest, a vain hope to get you to decide to give them a Christmas present, I would just wait and see what happens next. Meanwhile you and Mr M look after each other, that is much more important than any pesky DCA or bank

This is what makes this forum, site (whatever you want to call it) so special. The community on here is second to none.
Loopyloo and IF thanks you so much for hugs and kind words its so greatly appreciated.

MrsD how right are you as long as we have our health nothing else really matters (until you have a DCA breathing down your neck) but hopefully once meds kick in I shall start to be stronger again (Doc says I've taking to much over the years and now system telling me to slow down, easier said than done when you have a Hubby who is so bad with depression himself all due to his physical state of health.

Elsa, I would have been in a worse state than I am just now if it hadn;t been for you (nearly 2 years ago) guiding and helping us from CAG onto AAD and finding Niddy, your kindness is unrepayable, hopefully once meds do kick in I shall pick up, Doc says another couple of weeks if no change then she will change meds.

Then when I come on to here and see what others are having to endure I think give yourself a kick up the rear and get on with things...but, it doesn't work like that, if only....

to all of you, you are our inspiration.

                                Hi Folks...

To be really honest got a lot of personal and health problems which trying to deal with right now and now this has landed on our doormat.....

Over the years we had a few accounts with Aktiv Kapital nothing too scarey and basically they have left us alone apart from lots of tletters offering dicounts. Hevn't put this account in our siary yet as they weren't bothering us for so long....

We have just relised that out of the 3 accounts that they had two are SB which seems to have made them a wee bit irate to say the least as over the past two weeks they have been calling our home (luckily Truecall barring them) nearly ever hour every couple of days.

Now we have recieved a letter regarding the 3rd account which is not SB until late next year.

The letter says....(will have to type out dont know how to attach)

                                IMPORTANT INFORMATION PLEASE READ

We have written to you several times now about your outstanding balance, yet it appears you are still choosing to avoid contacting us.

This is your last opportunity to contact us to agree repayment on this account before we commence our review to determine our next course of action.

To avoid further action you can still access New Deal with the option of setting up a monthly payment arrangement to suit your budget or clearing your account with a full and final settlement amount from as little as (Basically 65% discount)

We have few other options left open to us now so if we do not hear from you within 10 days this may result in the following action:

                                1. We may issue instructions to our solicitor to commence legal action which may result in a judgement being recored against you.

                                2. We may pass your account for doorstep collections, where external agents will attend your home to gain a better understanding of your personal circumstance and your reason for non payment.

You can take up our settlement offer by caling us on .........and making payment via Creit/Debit card or by visiting our website and making a one off payment.

If you cant clear your account at this time then you need to call us so we can talk through your options with you.

We would prefer an amicable resolution, however should this not be possible by the specified date we will not hesitate to take further action.

Could this be a letter before action or does it have to be headed A letter Before Action.

Will set out a diary in next post to let you see how this hads traspired over the years...
