    We have all been there!

    You pay because you feel you should, you spent the money, why shouldnt you pay it back, we all know that way of thinking.

    And when times get bad, you pay what you can.

    But it gets to the point where you can no longer afford to pay there stupid interest rates, and no doubt over the years, paid them back ten fold with interest, enough is enough.

    Threats is all they have, and for some it works, but stay at this forum, read threads and after just one hour, you will realise, they are just threats, and you ARE the one in control.

    Dont worry about debt being passed to DCA's, the only difference is they like playing scare tatics more than OC's

      Ok having read the documents this agreement is in fact enforceable, so that part of things goes out the window. Therefore the only option you have left is a formal complaint to the FOS regards the harassment and way in which you've been treated, which would down the 'unfairly treated' route.

      Not brilliant news, but this is an agreement from 2003 and a lot of agreements from around this time (2001-2006) were 'good' by way of compliance within CCA. That said, have they defaulted you? Have you ever had a notice of termination?

          No probs, I was told it was in the first place so I'm no worse off than I was. I just need to know what to do about Arden. I haven't contacted them yet and have received 3 letters last week telling me to ring them. Can you advise me what to do, please? Sorry, croosed post!!!

          So the threat o gram letter is saying I didnt receive an enforcable CCA, but I really have???????????

              I haven't had any calls since my complaint to MBNA. Surprised I've not had any from Arden - yet!!!

                Can you just confirm that I am OK to send this even though you say that the CCA is enforceable? Will arden not know that I have been sent a CCA by mbna?

                Sorry for all the questions but would like to get my head round what the contents of the letter means and why i'm sending it, thanks.

                          No more letters from Arden, no reply to threatagram yet, but just received the sar. It looks a bit daunting, can anyone give me a clue what I'm looking for please? thanks

                              hi it will be worth an hour or so of your time to read some of the unenforceable diaries on here i did it makes some good reading and will educate you will take away most of your worrys it worked for me gave me my confidence back
                              at the start of this journey i owed
                              £52000.00 UNSECURED £5000.00 SECURED
                              £0000.00 secured debt as of 17/12/2010 fingers crossed
                              on 14/07/2012 i now have £32.000 unsecured and £15.000 unenforceable [thanks to niddy and aad ]
                              as of 17/03/13 its now £26K AND £15K UE
                              ITS COMING DOWN SLOWLY WHILE STILL ENJOYING MY LIFE
