    Letter written and I've now also sacked the DMC, who have been very inept in their handling of this case. I was telling the new case worker that I wouldn't in fact be paying a bean to the creditors any more as the account is unenforceable and he tried to moralise to me that I should pay it even if the paperwork isn't valid. With friends like that...

      Letter from Wescot: they've received instructions from their client to withdraw the account and I should receive no further contact from them.



      I presume it doesn't end here and that a game of musical chairs with various DCAs will ensue?

          I've had two things arrive today - toothache and a letter from a DCA. The former is more welcome, of course.

          The letter is a phishing attempt from the fuckwits at Ruthbridge, so maybe it's welcome after all for the comical relief.

          As it contains nothing specific, I'm just going to ignore this one.

            Barclaycard have been calling my mobile a few times recently. I have the number on block (the phone still logs the calls even if it doesn't ring).

            This has been a prelude to nasty things in the past, so I'm wondering what they're up to this time. They know the account is unenforceable and they know that I know it.

            They can't do an automated sweep of my current account if it's already overdrawn, can they? I moved what little remaining money I had to a new bank account, which they can't touch. However, my mortgage is still with one of the parent company's subsidiaries (and the current account that is linked to this offset mortgage is still open but overdrawn and not used as my main account any more), so I'm wondering if they're going to attempt to add their unenforceable debt to this? My understanding is that they can't actually do this but I'm wondering what's behind this sudden flurry of activity.

              Its unlikely.

              They cant offset any money you owe from an overdrawn account, the money isnt yours to offset.

              If they even attempted to take the money you pay for your mortgage, you could easily get them to put it back, so dont stress about it.

              If its a prelude to anything, its more likely you will receive a notice of assignment.

                      Picked up some mail from my old address and, despite all the drama that has been happening on the forums re BC and Marlin, I appear to have had nothing, nada, zip, zilch from them.

                      Barclays have, however, sent a couple of letters saying that my account was hundred of pounds overdrawn and that I needed to make adjustments to restore the account to order etc.

                      This is news to me, as I have had a £1,000 o/d limit account for over a decade as part of their "Platinum" account package (and the account is still showing as Platinum online) and the amount that is overdrawn on the account is within that limit.

                      But they say they've reduced the limit to the princely sum of £10. I haven't been given a reason for this. Bear in mind that I haven't been active on this account for many months, for reasons outlined earlier in the diary. In a word, "offset".

                      However, as far as I've been concerned, I have been operating this account perfectly properly. They've effectively frozen the account and are saying that any bounced transactions will be charged for and so will any authorised ones. Just as well that all direct debits and standing orders were cancelled on it then.

                      Apparently "interest will not be charged on your account" (although looking online, they have done exactly that) any more.

                      Unfortunately there were no statements waiting for me at my address, which I still need to get a RM redirection set up. I think I will write to Barclays to point out that I had not been informed of the overdraft being withdrawn or given a reason for them doing so, and give them a contact address.

                        After a complaint direct to the Royal Mail CEO, I now have redirection set up to my new address so Marlin won't be able to send letters or court papers to the old address without me getting hold of them.

                        There is a few days' window before that starts up but even if one letter slips through the net before then, I'm unlikely to miss them all, aren't I?

                              When Gold isn't enough, there is SA Gold! New to the forum and find the UE route a bit scary? Take a look at my diary here and judge for yourself. I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

                                I wonder why others have had a letter from BC and Marlin, and I haven't though. It would be nice to think it's because they can't find a valid CCA but I've never had the letter admitting that. Egg sent a reconstituted agreement and tried to bluff that this satisfied the request but I sent a Niddy special to refute that. When Barclaycard took it over, they just passed it from one DCA to another and the I heard nothing.
