      Re: evilcartman UE diary

Well, I've been checking my CRA files to see what "they" might have on me. I paid off an outstanding overdraft with my previous bankers in full a month or so ago. With one of the CRAs, there is no mention at all of this overdraft (making me wonder why I'd bothered ). However, I've checked with the other major CRA and they are still showing it as defaulted, so I have raised a dispute on that and also emailed my contact at the bank to chase that one up.

On the UE card matter, I noticed on the second CRA's report that "Cabot Financial Europe" had made a "Trace Enquiry" last September. Now by the looks of it, I don't think this CRA had linkage to my current address until I requested my statutory report. The other main CRA did have linkage, but there is no sign of a search by Cabot on there.

I'm not totally up with these developments, but am I right in thinking that Marlin is now Cabot? If so, there may be interesting times ahead, as the UE card is two years off SB. However, I'm not afraid of these bungling buffoons and the fact that I decided not to hide any more (by not linking my present address to the previous one) is a reflection of that. All the previous 'owners' of this account failed to provide an enforceable agreement, so I doubt that they have suddenly got lucky.

I've seen this post on your new thread so I've copied it here.

But it only needs one entry, as I believe the alleged Egg card debt is now STATUTE BARRED!

There was a default notice issued on 7 July 2011. It is now 8 July 2017 and I have never acknowledged the debt in all that time. So that means it is now statute barred, right?

Can you just clarify when you last made a payment to anyone towards this debt?

Thank you, Diana. I'm sorry, the thread didn't come up in searches so I thought it had been deleted.

I don't know the exact date of the last payment off the top of my head but it was several months BEFORE the default notice was issued. I'll try to find the exact date but I no longer bank with Barclays, where I had my current account at the time, so I may not be able to track it down exactly. But I can state categorically that there was no payment and no acknowledgement of the debt since I started the UE route, which was several months before the default notice.

Would I be right in thinking that the debt won't fall off the CRA files until the next calendar month? I'll probably request my files from each of the main CRAs next month, then see if I can apply for a better status card than my current Capital One, which I obtained a year or so ago for credit repair purposes.

I need to sift through correspondence on my old desktop computer to check I didn't inadvertently acknowledge the debt. I'm pretty sure from email records and early posts in this thread that I stopped paying in early 2011. I'm not completely clear yet if I said anything that might be construed as acknowledging the debt since then as I started the diary on here in 2012 and I only discovered the default had already been applied in hindsight. So I need to double check any correspondence I can find to be certain.

OK, from what I can gather from old correspondence, the last payment was in early 2011 and I wrote to say the account was in dispute in February 2011. The last time I wrote to Egg was in April 2011, after which I started on the unenforceability route. I can't find any evidence of me acknowledging the debt after that.

So hopefully I'm in the clear?
