      received response obliged to provide you with a 'true' copy of the CCA & most recent available statement to the a/c with amounts and due dates of future payments that still require to be made. In terms of CCA copy doc regulations, the 'true' copy requirement can be satisfied by providing a copy agreement at the date the card agreeement was made and plus a copy of the current terms of the card agreement. Records show that there is still an outstanding balance on the a/c is currently being managed by Financial Hardships Team, therefore contact them directly to obtain details of the required repayments to settle the a/c. I can confirm that yr a/c has not been sold. Emailed Niddy.

      received response from Tesco Data Protection Act 1998. We enclose copy information held by Tesco Bank is provided under the term of the above Act and was located using the information contained within your request. Emailed Niddy.

        Lovemoney. Sorry to bother you but did the CAB help you prepare your case on the day of the CO hearing and/or did you have anyone to speak to the DJ on your behalf in court like a duty solicitor?

          PlanB. Sorry for the delay...
          Don't have to feel sorry that we all here for helping each other.

          Objection letter & Witness statement prepared by myself (did copy some & there ) and with husband help (emailed Niddy to check over). On that day we arrived to Court an hour early & found no duty Solicitor available in that Court except CAB. We did speak to her and she looked through some paperwork. Apart form what we already knew there was not much help, what happened in Court was really out of my hands.

            Depends when you last sent it - if recently then no don't bother. If 3+ months ago then sure send it again

                        received letter from HSBC saying they can't provide details of First Direct a/cs as these are held by a seperate legal entity to HSBC Bank. Therefore need to write to the correct data controller address enclosing the £10 statutory fee:-

                        received letter from F/D saying request for information under the SAR unable to assist and have returned £10 cheque. In order to proceed with the request need to complete an application form enclosed and supply with an original signature have 40 days from then to process the request.

                        Further advice needed please....

It was confirmed by the Judgement of his Honour Judge Waksman QC in Carey v HSBC[2009]3417(QB) that providing a reconstituted copy of agreement is compliant with S78 no requirement under the CCA to provide with a photocopy of the original signed agreement. Received photocopy Original Agreement & Defaulted Agreement (Emailed Niddy).

                              received a reply from LINK thank you for yr letter dated...we confirm that we shall remove yr contact telephone no on the a/c on the proviso you enter into proper dialogue regarding settlement of yr outstanding a/c. The a/c is in arrears as you have made no payments on the a/c since 20/3/12. Please confirm yr payment proposal by return.
