    I dont say they would get the order, merely they would most likely try for it. Look at your case with Santander as an example, they said they would do all manner of nasty things like getting judgment, they tried but failed but none the less the fact that they would fail didnt stop them trying did it.
    I'm sure they would have succeeded in doing all those nasty things if I hadn't been fortunate enough to have damn good lawyers representing me I wouldn't have stood a chance on my own in front of that DJ

    Which is precisely why Lovemoney should seek out the Duty Solicitor when they get to court tomorrow

      Good luck from me too When we went before the DJ for a charging order we pointed out if they were given one all the other creditors would probably follow on in our case would have been 15 charging orders DJ refused CO as long as we paid the judgement (which we do every month).

                              I'm back.
                              Sorry to keep you all waiting... (been busy).
                              The bad news was that they granted the Charging Order , the DJ based this on the fact that I'd already admitted the debt and had a CCJ for £330.02 a month against. However because I'd been paying the £1 per month he put in a condition that as long as I paid £1 per month without fail Hillesden Securities (DLS) couldn't apply for sale of the house, the solicitor for them reluctantly agreed and that was it. Not a good result in the long term but for now it was quite an escape.

                                I call that a positive result - well done! Shame about the CO, but at least they can't force a sale.
