I expect HBOS will now sell it on again to someone else. HBOS would have little choice in taking it back - as Lowells letter states, they were sold the debt on the understanding that there were no valid disputes.

Its crazy they sell it knowing it will get returned . Id buy it for 10p in the pound !!

With my Marbles card capquest bought the debt in November 2010 sent them letter from original creditor saying no CCA in November 2010
they wrote back December 2010 saying account on hold. Not heard anything sinse.

This might sound a bit dim but how do you give thanks and why do you get thanks received when you not done anything?

Some poeple do it so you know your post has been read / acknowledged, others do it as a book mark for posts they have read and to be notified of responses.

Used to be on a diff forum and Priority One guided me over to hear wish id found it a long time ago but better late than never

Keep that letter and any others that you have that show they can't find the agreement and can't therefore satisfy your s78 CCA request. They may come in handy as exhibits if someone else gets hold of the account and thinks they can collect from you regardless of what the CCA says. Hopefully HBOS will just chuck the account in the bin though. Far be it for me to praise Lowells but they have just done exactly what they shuold do in these circs and they have clearly explained their reasoning for it too.

Not heard anything from Capquest in nearly 3 years since they bought my Marbles account had letter back then saying account on hold.
They have added over 3k to the balance since they bought it tho.

Since they bought the debt about November 2010 .
Told them then that account was in dispute and that original lender wrote saying they couldn't supply a recon.
Then last week 3 phone calls all different numbers from them and a txt saying log on to their site quoting a reference number .
I think not !!

i had another 7 / 8 calls off Capquest and a letter saying they were going to pass all info onto a specialist team to sort out.
Should i remind them that they wrote 3 / 4 years ago saying account was on hold and that id sent them a copy of a letter from the original creditor saying they didnt have a cca.They seem to have forgotten they wrote saying this.
Or should i just ignore. It will be S.B. in about a year.
