Re: Halifax Recon ? or con ?

As planB says above, I'd leave it well alone.
I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

There's nothing to stop them trying it on ....but what can they do ?

If you're certain that it is SB already then wait a few more months (so there's no disputing that it is definitely SB) and then try and reclaim direct from the OC. Worst case is it would be offset against the debt if the DCA are not fully assigned and are just managing the debt. If however it was fully assigned then because the reclaim is between you and the Original Creditor (OC) they'd have to issue the refund directly to you because the account is no longer theirs - it belongs to the DCA and they cannot pay it the DCA as it is not their money, it's yours (the bank would already be paid from the DCA for the purchase of the account and thus cannot pay your monies to the DCA (with your refund) nor can they offset with the DCA's debt).

Doing a reclaim via the OC (once it is already SB) does not reset the clock - it's SB already so that's it - they've lost the right to enforce it through the courts.

          Make sense?

Check back through your file to make sure you haven't accidentally acknowledged the debt in correspondence. SB isn't only about the last payment date.

Also when did you receive the default notice if your last payment was in March 2010?
