Re: What to do when your account is Assigned?

Well obviously MBNA have been offloading accounts at an alarming rate this last few weeks to various DCA's who will no doubt soon be casting their nets out hoping to catch out the unwary and vulnerable with their usual threats.

It certainly rattled a few of us here for a time, so I feel really sorry for the many non AAD members still out there who need to find out these threats are usually not worth the paper they are written on.

Hopefully they will find their way here very soon. !

Re: What to do when your account is Assigned?

Where an account has been notified to you as UE(No docs available) and the OC still employs various DCA's as paid 'threat O grams' for results. Then the DCA request(s) to pay up etc etc should surely be ignored as clearly the OC are just using bully boy tactics for an account they know cannot be collected,in the hope that we fold in through lack of CCA knowledge. The account is unassigned and still belongs to the OC.
Am I on the track here Niddy?

I've got a set similar to these. One interesting thing is that the account number is different from the MBNA account number, but nowhere is there a link between the two.

Should this be pointed out or can it be used to hurt Global at a later date?

Fred, If the letter you received from MBNA along with the Global assignment notice is standard issue, then it may read as mine does - MBNA point out that the account will now be allocated a new reference number by Global.
The MBNA letter will bear your original card account # and outstanding balance
And the Global notice bears the new account # and corresponding outstanding balance

So in answer to your question, if you have received both the letters as I mention above, there is the link, you have been notified of a change of account #
So I doubt if any any argument could be put to Global in this respect.

If you have more than one MBNA account, just make a note of which new # has been allocated to which account to avoid getting confused in any future correspondence.

              Hi Alland,

The letters I have (both in the same envelope), mention the new account number but NOT the old one. I only have 1 MBNA account so I know what it's referring to, but logic tells me that THEY should link the two. What is to stop me saying to them, "sorry, don't know what you're talking about because I don't recognise that number"?

              Regards.

              Fred

Re: What to do when your account is Assigned?

Credit card numbers can and do change all the time. My MBNA one has changed several times. A&L and Abbey ones changed when MBNA took the accounts over 2003 and 2001 respectively. HBOS ones have also changed when MBNA took over.

Your account number will also change if there has been fraud on your account, or you lose your card.

There will be a paper trail thats not difficult to prove. While the account number changes at assignment, this is purely for admin purposes. The fact it has changed means squat.

Is this still on discussion? Account numbers mean nothing. Forget it. Move on to the real errors like s.78, s.87, s.88, s.61 etc etc

If the alleged debt had indeed been 'given', then no consideration would have been given in exchange.

Hence, I sought to question whether or not the assignment would be quite valid, even before one started to consider the donor, donee and witness signatures on the deed of assignment.
I have one(see diaries)where the account after being sold was'given back' to the original OC.
                        Who therefore legally owns it?

It would be the original creditor, so there would be no need to involve the (link) Bona Vacantia Office.

In my original question, I expect that no exchange of consideration needs to have taken place for a valid assignment to have taken place.

                              Hi,

As pointed out by FP on my own diary (thanks FP) MBNA are selling everything off as they are moving out of the UK market.

I have the same as PIP. My MBNA & MBNA (Virgin) accounts have been sold on to Moorgate without NOA. Just letters saying its been sold and obviously giving a new a/c number as they always do.

My problem (or maybe not a problem?) is that I sent my CCA for these accounts on 19th January & 21st January and haven't heard anything back from MBNA apart from a letter dated 25th January (and letter from Moorgate saying the same) saying Moorgate are the new owners from 30th January.

So, with the above in mind, do this mean that MBNA will just not bother sending the CCA? (probably haven't got one anyway) and now as per the earlier debate, wait till Moorgate contacts me or do I push for the CCA so the accounts can be closed by MBNA?

                              I hope this makes sense?

I have posted on my diary anyway and will await instructions from Mr Niddy. Im just curious now as obviously the 12+2 days is up tomorrow and Saturday!

You sent the request and have proof. Thus they must respond or they're in default of your s.78 request and cannot enforce anything. You actually sent the request at the perfect time

However mbna will no doubt respond to your request - maybe not for a while mind

Just sit tight. See what happens.
