      My Barclaycard statements now say that Mercers Debt Collection Agency (barclaycard) is now dealing with my account although I have had no letters from Mercers themselves. They are however calling the phone a lot now. 3 times yesterday and so far 4 times today. I have not answered the phone to them. If I do answer what should I say to them?

      Received a letter from KPR Debt Collection today with the words FORMAL DEMAND FOR PAYMENT in bold and threating that Nationwide will take me to court etc etc. Oh and at the botton of the letter in small print is says KPR Debt Collection is a business name of Nationwide Building Society.

        Don't deal with any DCA over the phone. If you pick it up and it is one, either say you're only dealing with this by letter and politely say goodbye, or give them the wrong security question answers. Better still, change your phone number.

          Niddy has created a selection of telephone harassment letters which can be sent, starting with this one:

          I sent it to Barclaycard, and then a follow up one - and it worked for me - phones blissfully quiet now, without having to change numbers - worth a go?

            You need to ensure you have sent a CCA Request off, obviously?

              Hi Niddy. I was away for a while there so I have not sent anything other than the CCA requests so far.
              I sent the requests 2 weeks ago today and they were signed for on the 18/09/10 and I havent had any response.
              One thing I am worried about is that both the Nationwide and Barclaycard CCA requests were signed for by the same person. I'm concerned I sent them to the wrong address now. Doh!
              Here are the address I used.

              LE18 9BG


              Barclaycard Customer Services
              PO Box 9131
              51 Saffron Road
              Leicester
              LE18 9DE

              As I said in a previous post KPR sent me a letter on behalf of Nationwide. I have also received 2 letters from Mercers as well.

                So, the reason they were signed by the same person suggests one of two things - that the local PO signed for them or the delivery driver - remember a PO box address is a box in the sorting office and usually you don't send things recorded to one, if so then the PO do one of two things:

                1. The local delivery/sorting office signs for them and hands them to the driver to deliver with the banks usual mail

                or

                2. The postman will filter them into his normal round and sign them, but just post through the door with any other mail the company has.

                Now what you need to remember is both these firms have 1000's of letters sent to the PO Box daily so you'll find they are all signed for at the local sorting office and then put into a sack and delivered with the other mail, as one bulk delivery. Don't worry about it, the fact they have been signed for is proof to you (in court, if it got that bad) that you sent the items in question.

                Just sit tight and give them a couple of weeks then update us....

                      Ok, letter 1 is a standard doorstep threat - respond with this: ---> viewtopic.php?p=182#p182

                      Letter 2 is a normal default notice - improperly executed as it does not clarify that to avoid the breach and remedy the account, you must only pay the "arrears" by (9th october) - muppets! However don't worry about this - just ignore it.

                        Wait - i'm still updating your thread!

                        Answers are all shown with how to respond. Do not chase the CCA's - whilst these remain outstanding NO formal action can be taken so because they are making these threats, little do they know they cannot actually do much until they comply with your lawful s.78 request - stop worrying, I kinda know what i'm doing ;-)

                              Hi NID.
                              I got a letter from both Barclaycard and Nationwide saying that my complaint will be dealt with by 31st October. I also sent the reminder CCA request to both parties.

                              On another note and another Debt (apparently).
                              I had a hosting account with 1&1.co.uk. Haven't made a payment since my card was declined when they tried to renew my package and domains. They have passed this on to Arvato Finance who have added 15 quid on top on the debt. I have been ignoring all this but the other day I got a letter from HL Legal & Collections Solicitors saying there will be no further warning etc. I will attach the letter.
                              Ok so I had a look at the 1&1 account and the payment are for the following year.

                              Example: Basic 1&1 Package from 18-07-2010 - 18-01-2011

                              Now when the payment was declined the service was suspended. Same goes for all the domains I have registered and they want payment for.
                              Hope you understand what I mean.
                              Should I start a new thread for this one?
