      oh ill need help lol dont no weather to laugh or cry at the moment ,ill get my diary started soon just got 2 jot a few notes down (memory like a thingy) lol and many thanks my friend..........

        Hi Plasman welcome to the forum.

        I definitely recommend the laughing option, it is less painful and crying is stressful and doesn't help! Have a read of my diary and you'll see I am in the same boat as you. I used to worry and lose sleep but I learned quickly from the great folks on here that there is no point. I now feel so much better about things I cannot begin to explain.

        Anyway, setup your diary and trust Niddy and his crew 100%. I know it is hard at first and that you feel nervous etc but it is the best way to go about things.

        If you need help then just shout.

        Some simple advice to get you started.

        1. Keep good records. e.g. all letters you both send and receive should be filed away for each debt. Always send your letters Signed For and staple the Post Office receipt to the relevant letter.
        2. NEVER sign anything for anyone if it relates to your debt. Just digitally sign it i.e. Print your name via the PC and that's it. Read this Sign Digitally
        3. Do not converse over the phone. Only communicate in writing as this helps to keep proper records and stops the stress from phone calls. You can ask that they only communicate in writing using this template Telephone Harassment
        4. Trust Niddy and the crew 100% - if you are unsure then ask for clarification, they always tell you to do things for the right reason although you may not always understand at first.
        5. Relax; worrying doesn't help!

          Thanks MJ, your comments are much appreciated. Hi plasman, all of us are volunteers, most of us have been or are still in the same boat as you. Niddy is the REAL thing with all this stuff, don't worry about asking the simplest of questions or ones that may seem stupid to you. Abuse is just not tolerated here and is dealt with immediately by the moderators and site team. Yes we do poke fun at one another a bit (well a lot really) but laughter and fun is part of the healing process to get you confident enough to deal with problems of debt. No one said you can't have fun just because you are in debt.

          Everyone here is honest about their own and others problems and you will be told if something is enforceable or not as the case may be. It won't stop there either, if something has to be paid then we will still work with you to achieve the best resolution for you at the least cost to yourself. We have preferrred solicitors who are specialists in this field and ONLY represent the consumer/debtor. One their senior people is a moderator here. If heaven forbid it gets that far we can refer you on to them but you are a million miles from that at present I would suggest.

          We all had to start somewhere and much of what you see is collective experience knowledge. Niddy has a secure area which he will give you access to once you a diary going, to which you can post post documents and correspondence that you get which are better kept from public view.

          Have a good read around and see what others have done and achieved as maui jim has said he came here in the depths of despair and became a convert and has a better life for it. Thats is more than reward enough for all of us on the team here.

                Hi all again ,I sent 3 cca requests to mint(rbs)opuscard,and barclaycard .....got a reply today from barclaycard they sent me a reconstituted clopy of there cca terms and conditions ,along with this letter

                Account no xxxxxxxxxxxxxxxx


                Reference;section 78 of the cca 1974

                I refer to your request for information
                goes on to say what they must provide 1974 cca (the act)

                I enclose a reconstituted copy of your credit agreement.a copy of the terms of your credit agreement as varied in accordance with section 82(1) of the act has been (or will shortly be)sent to you under seperate cover.

                then on the next line just says a statement of account below ,

                so no cca yet im guessing they still need to send more stuff out,as all they have sent is a poor copy of there terms and conditions whats my next move ,do i wait to see if anything else comes ............thanks

                      ok so barclaycard have sent the cca (agreement) and its got no signatures on it at all just says its the terms and cons that exist between us ,im going to wait till niddys back and practice scaning so i can send it for him to have look also had one pretty much the same from opus they say the original agreement stands from citicard and again no siggy just looks like a recon ,ill update when niddys back and refreshed from his hols
