      Just ran into another problem.
      I have an Egg card, which I have left on direct debit. Now I noticed that on Friday I didnt have enough in the bank and got £12 charge. If I cancel the EGG dd will I get in more trouble?

      I am sending for the egg CCA this week, would it be best to wait until they send it back?

      So glad I was invited here , I would just have no clue at all otherwise

        Glad you made it here, its all very confusing at the beginning, for the moment I would cancel all of the DDs to any unsecured credit, so cancel the Egg one until we can see what is happening. I think, reading the thread and your posts on MSE, that you simply don't have enough coming in to pay your credit payments, so you need to stop for the moment, let's look at the CCAs and then have a look at your options. As Niddy says, if they don't produce a CCA within the time they are in default, so you wait until they produce! No reminders or encouragement, they are in the hole this time, so leave em there!
        and you are certainly not a bad man and no one is locking you up, its 2011 and not 1711!!! we are mostly in debt on here, some of us enormously in debt, have a read at some of the UE diaries and you'll see what I mean. i gather you aren't working, are you sure you are claiming everything you are entitled too? it's another very confusing area so not a bad idea to check. its also not a bad idea to give us a general overview of the whole situation, moneywise, helps us to know all the wee dark secrets!! Try not to worry and read those diaries, in the debt game, knowledge is power and the banks rely on you being ignorant to get their own way.

            ELD has definitely given you some good advice. I am in serious debt and at first I went through similar emotions to you. In my mind I felt I had failed in my duty as a Father, Husband and bread winner. Then I joined MSE followed by this site and then my whole mindset changed.

            I was having sleepless nights, nausea - thankfully I can't afford to drink !!

            Now I have decided to play the banks at their own game - dog eat dog! I realised that provided I pay my mortgage, council tax and utility bills the rest can go whistle! Only when I improve my situation would I consider paying off any unsecured credit and that is a long way off!

            If I can use UE to my advantage then you can bet your last penny I will and if they don't like it then in the words of Homer Simpson "they can kiss my hairy yellow butt!".......even though it isn't yellow!!

            Stay positive, stop beating yourself up and follow they advice from Niddy and the crew!
            Some days you're the pigeon, some days you're the statue. I currently spend too many days as the statue......but thanks to this site not as many as I used to!

              I have just been thinking about the CCA I am waiting for from Asda (Santander).....They dont sent via recorded delivery so how do I know if they sent it and it's been lost in the post?

                Who cares?

                They would be in default if you don't get it!!

                Read mrs dopeys post. Stop worrying and stop all payments then update when you DO get anything through.

                  Just a follow up question or 2 while I am awaiting various replies from creditors....

                  What do I do if all debts are enforceable? Do I move straight to asking for reduced payments/token payments/interest freeze?

                  I am scared to death of baliffs coming to my house, can they take stuff that I say isnt mine?

                  If Santander dont send the CCA how long do I give them until I ask again?

                    Not sure exactly what the steps would be if they were all enforcable so you need Niddy or someone else for that, BUT baliffs cannot come to your house until you have a) been taken to court, and b) have not paid what the court has told you to pay, and that will be an amount thats affordable by your i&e so slow down as the DCA's use baliffs as a threat to get you worried and paying them.

                      Wait & see what (if anything) they send back.

                      No need to go chasing them for documents, let them do the sweating.

                      All they can send to your house are collection agents and they have no rights to enter your property.

                      Just chill you'll be fine.

                        And to follow up swanny, it is only an IMPLIED licence under English for them to visit your property. That licence can be revoked in writing, (template letters) and they may only then visit with your express permission which you don't give and don't fall for the tricks on the phone of making an appointment.

                        If they then visit (relatively unlikely) they are committing the Tort of Trespass for which you may claim fiscal redress, if they come a second time it becomes aggravated trespass which is criminal and they may be arrested if you call the police.

                        So BA don't worry about home visits. They will write, respond with the template letter and if and when they do come send them away with a feal in their ear and do not enter into any discussion with them.

                        Until such times as a court order has been granted to any of them, their ONLY weapon against you is your own fear as to what they might do. You are here and that can easil;y be overcome. They have NO legal powers or authority WHATSOEVER.

                          Just an update. Not received any contact from the Asda card yet.
                          I think thats 14 days now, they received it and signed for it on the 15th July....

                          On another note, I also have a store card with Argos and an account with Very. Can I CCA request these too? If so, Is it recommended that I do?

                            OK BA, remember what i said about letting us know about all your debts?
                            are these being paid? in arrears? defaulted? recent?

                            if you let us know this and then send for the CCA, we can go on from there.

                            and try not to worry about the non-appearance of documents from creditors, we're over a year in, and had 22 creditors, some of them STILL have not yet produced anything, so don't worry, until they produce a properly executed agreement they are in default and the debt is unenforceable, so try to relax, its very very early days!

                              Argos card, very account, additions (now very) are all up to date, but I am struggling now as I am with the others.

                              I bet nobody else has 2 very accounts in their name..... It was confusing at first because additions didnt tell me they were changing names to very. I know they are the same company but it threw me for a week or so...

                              None of my credit accounts were in arrears until about 6 weeks ago. Then I hit a brick wall and everything came on top.

                              when I checked my credit file for start dates etc, I had no defaults. Although my score had dropped from 750 to 540
