          Hi Blue Army,

          Sorry I've been a bit out of this today. Having read your post this morning and now just read the remainder of the comments I stand by what I said in my first reply. Whatever the date of the agreements, I think it's always good to ensure they have the agreements to make sure they're enforceable - they are likely to be.

          If you have no money, then obviously you cannot pay, it really is as simple as that. There is absolutely no point whatsoever in worrying about anything. I've been there, done it and paid the consequences in terms of health. As Niddy said, it is not a crime to be in debt and they can't take what you haven't got. I also understand it's easy to say don't worry, but depending on your personality you may or may not be able to do this. If you can't, at least try to come to terms with what I've just reinforced - they cannot take and you cannot pay what you haven't got.

          You might find it useful to fill in an income and expenditure sheet, I imagine someone will be able to post a link to one on here. This will help you to identify what is going where and it can help you make economies sometimes. Whatever is left can then be looked at.

          A DMP sounds an unlikely option as it doesn't sound like you'll have sufficient disposable income to make this viable. Making a nominal payment as a goodwill gesture is probably more realistic, but until you are sure of your disposable income it is not possible to say for sure.

          The one thing I would love to change if I could wave a magic wand on this post is your statement about you being the bad man. You are not bad. Not having money does not make you a bad person. Being in debt does not make you a bad person. Please, try to accept this - you are not bad, and you simply cannot pay what you have not got, so there is little point in worrying - that only serves to exacerbate things.

            I would just like to reiterate what Caspar and other members have said, having been in the same situation as you only 3-4 weeks ago, things do get easier once you take stock of what disposable income you have and get your priority debts in order and start to deal with your debts I can honestly say I worry less now than I did 4 weeks ago, knowing you are not the bad person in all this but just caught up
            in circumstances that were beyond your control but now is the time for you to take control and and with the help of the good people on this forum fight back as others have said they can't take what you hav'nt got so don't worry there are a lot of us in the same or similar situation to you, take it from me you are in good hands here

              thanks for the messages, helps me a little. Nominal payments worry me because interest and charges will just keep building.

              Like I said, I will wait til I get all CCA's then move from there.

                  Hi Bluearmy.

                  Please stop worrying about interest and charges - you are doing yourself no favours. When we say you have nothing to worry about - we mean it!

                  I started looking at my debts over a year ago. Some I have paid NOTHING to for over a year; I'm still here to tell the tale Interest has been frozen on those and no charges are being added as they have been sold on to other agencies.

                  For the debt that I am paying back (slowly!) I am paying back 0.15% of the balance each month - yup, 0.15% (so for a £10,000 debt that means £15 a month)
                  There are no interest charges being added, and no additional fees on this debt either. The only reason this one is being paid is because it is a business overdraft which hubby is involved with - and he won't ignore it (much as I've told him to).

                  Whatever your circumstances, believe me, they cannot have what you haven't got.
                  This time last year, like you, I thought my world was ending and anticipated men turning up and removing my sofa, tv, washing machine etc....... it just doesn't happen!

                  Stay calm, apply for CCA's on all of your debts, and let us help you.

                    Just an update, I am still waiting to receive my CCA from Santander (ASDA). It has been 10 working days now. I hope I sent to the right place. I just posted to the return address for the postal payments.

                    As for Virgin Card, I have the CCA and as I said its 2008, but they are phoning at all hours. Is there anything I can do to request lower payments? Or do I just make token payments of what I can afford?

                    Still got barclaycard and egg to send CCA requests off to yet also.

                    I am worried at moment as the last date for min payment is approaching on them all.

                      Dont worry as they have already said, CCA requests they have 14 days after that if they dont reply all the better for you. If you read a few diaries from the start of peoples UE journeys you will see they cant do much or have what you havent got.

                        After 14 days they are in default meaning they cannot enforce until they come out of default by issuing a compliant cca. Just send off for CCA's and email them to me - the newest ones you need to sit on until we know the final outcome, then consider a dmp on those....

                        Don't worry, whatever you do. If you can, change your number. If you can't then look at calling them before you're in arrears and say "you cannot afford to keep your phone or mobile and so they'll be disconnected within the next week and can they remove your numbers" - this is one way to get rid at an early stage...

                        If that doesn't work, then simply send these, as and when you may need to utilise them...

                          The phone calls dont really bother me too much as I know the numbers they call from and let it ring off. Just getting later and later.

                            Monitor and document each call time - this can be helpful if they try and enforce....

                                OK, think I have uploaded my CCA from mbna correctly.

                                Now I just checked the Asda (Santander) tracking and it was sent on 14th, delivered on 15th. So they only have a few working days left I think.
