    Good.

    Did the solicitor give you an outline of what is likely to take place at tomorrow's hearing; in other words what is the purpose of the hearing?

    When tomorrow is over you need to get a copy of everything filed with the court because at the moment we're boxing in the dark.

    Fingers crossed tomorrow goes well for you and report back when you get any news.

          They confirmed it was an options hearing.

          They have told me that they can't do much at it tho as they are not representing me and that I will have to attend myself at some point- so all they can do tomorrow really is explain where I am, my intentions and then apply for another options hearing in 4 weeks.

          I think I may need to look into legal representation for this as although I find it interesting, its very time consuming and as I'm starting a new job next week, I just don't think I have enough time to deal with it all. I'm finding that what i think should be fairly simple procedures, usually turn out to bureaucracy wrapped up in red tape! Where's judge Judy when you need her!!

          Do any of you know of any good solicitors I could speak to regarding my options here? No win no fee would be perfect as at least I know they're gonna work their socks off to win!

                Will the Options hearing be an opportunity for you to ask for the case to be transferred to your local court?

                  I did ask my solicitor to do that but they have told me that whilst they can do so I would ultimately have to do this in person as they are not representing me, and that this would have to be done by lodging a motion with the court and shoosmiths (sigh)

                  Also having done some more reading I now see that there is a choice of a debate hearing or a proof hearing. I have a suspicion that shoosmiths are going to ask for a debate hearing tomorrow. Does anyone have an idea as to which would be to my advantage... I kinda thought/hoped a debate based on proof would've been the way forward here...

                  Thanks, Dec wasn't a great month as this writ arrived 3 days before my redundancy was announced. All good now tho, new year, new job, new town!

                        Hi all!!

                        Still waiting on an email from the solicitor summarising exactly what happened but from a quick phone call I received from her it appears that not a lot took place...I was told that another options hearing has been scheduled to take place in two weeks time. Other than that I don't have any information yet. I have already emailed the solicitor this morning to request a summary of this along with the new date and absolutely everything she has on this case. I'll have to chase it up again tomorrow.

                        First thing I need to do is get the hearing moved to my local court house. I'll start on that tomorrow.

                        As soon as I know anything else I'll post it up.

                            Agreed! That's something I need to look at pronto as I'm starting my new job next week and I dunno how much time I'll have for this.

                            I've had some great advice from folk here already on my current legal standpoint. Can anyone recommend a solicitor that could handle this..? Preferably up to speed with Scottish law and handy with this type of trial..?

                                OK, so I just got an email from the court clerk telling me my options hearing is now scheduled to take place in under two weeks time. I will not be in the country on this particular date due to work commitments.

                                Also, it appears that the solicitor I used did not lodge a motion to have the hearing location changed - not that it would have made much of a difference, because I wont even be in the country for it anyways.

                                Again due to the short timescale I have and the fact I won't be there, the only way I can see around this is to get this solicitor to represent me at this hearing... Move it past the options hearing stage and also lodge a motion to change location. Then i can pick this up afterwards in new location. Although to be perfectly honest, that's what I thought was happening last time.

                                More money I don't have!
