One wonders if, you have been provided with same or, if you have are they the correct 2002 issue?
Also, were the term varied correctly as per section 85?
Egg Card is now owned by Barclays plc, therefore you can reclaim your mis-sold or mis-applied PPI from Barclays, together with any associated contractual interest that accrued on those PPI premiums.
Hopefully, Niddy will agree with the above view?

Originally posted by Angry Cat View PostOkay, we have now established that the terms of the original agreement were varied. Therefore, under the copy docs regs, reg 7, you would have had to be provided with a copy of the original terms circa 2002.

I defaulted 2006 so these sem to have been changed.
Ho do I claim my ppi back? can I still do it even though I've defaulted?
That could go towards my F&F offer..

Re: EGG agreement
Confused
This is like extracting teeth from a vampire!
You stated here ( #29 )that they started taking PPI in 2007 - yet above, you stated they defaulted you in 2006....
You need to clarify facts therefore for the time being, send one of these to Barclays so they can furnish you with accurate details cos right now we cannot afford to risk helping based on looking idiotic as we're really none-the-wiser....
Send this (with £10) Subject Access (SAR) - Advanced Request
Then update us when they respond, obviously DO NOT SIGN IT!!

You defaulted on the credit agreement in 2006.
Four years had passed, therefore the original terms of the agreement had of course been changed/varied.
Was your egg card, changed to egg card blue?
You can still reclaim your PPI premiums plus the interest that accrued.

Could the PPI reclaim go against your F&F?

I would suggest that you calculate how much is owed to you re: mis-sold/mis-applied PPI.
Obviously, Sam, don't make any offers or anything as yet - send for the SAR then update us and we'll advise what to do / look for upon receiptI'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. Post #48 is correct that I started paying PPI 04 - 07.
I defaulted on the accuont 2006 and was issued with the default then but I paid via the CCS until March 2007.
I have sent a SAR to Lowells and have all my statements, should I still send one to Barclaycard?Last edited by sam; 23 July 2011, 09:37.
