      Re: EGG agreement

      OK Niddy we'll forget the PPI for now as you highlighted SB in another post..
      Below is the latest letter I have just received..

      OK I was going back through the statements that they sent me and the last direct payment I sent to EGG was 21 Nov 2005. I did make some CCS token payments after that but they have never shown up on the SAR nor did the debt decrease.
      Should I keep sending the missing prescribed terms to stall them until November then go for SB??

          Perhaps they intend it to dissolve once it is past the U-bend.

            I never got chance to send that letter above Niddy as I just got the one below!!
            Right, the last time they sent this letter we responded with the "missing prescribed terms" letter and it took them 5 months to reply...
            Do you think it's worth trying to send them the "missing prescribed terms" again in the hope it takes the same time as before, as that will take it to SB?
            Or will they not comply to it again?
            It was EGG that took the 5 months to send lowells the docs.

              I am not sure whether challenging the terms of an alleged consumer credit agreement might be considered to be a form of acknowledging that the alleged debt - however unenforceable - does exist and that you owe the money to the inept creditor.

                  Any offers on what should I do now?
                  Make an offer? Blag it with a "missing prescribed terms" or send the "You know nothing of the Debt / Prove It"
                  As this could be SB Nov 2011 if Niddy says challenging of the terms is not an acknowledging of the debt.

                    Hiya

                    Ok, lets put things into perspective, calm things down and put them back into logic....
                    1. Nobody can make you bankrupt, certainly not without first attempting some other form of action such as enforcement of the debt;
                    2. You have an outstanding CCA Request (don't you) so they cannot enforce anyway, regardless;
                    3. You can at any point pay this and walk away (via F&F offer);
                    4. You request CCA and/or disputed the account thus SB is now ineffective, you can get away with sending the "prove it" template, not however the one you did sent, which is more a defence of the legality of the account status (ie unenforceable) - if you are querying the existence of the debt you'd be sending the template you did send so you've actually brought it out of SB so forget that right now;
                    5. Continue with your PPi Reclaim as per other thread with Di30 and then lets look to make a sensible F&F when you can afford it.
                    So, from the above, If I was you right now i'd sit tight and do nothing, see what they want to do. However based on the letter you got from Red - can you email me that so I can see it as I may do a response to remind them about making unfounded unlawful and downright illegal threats.....

                      OK cheers Niddy.
                      I got the CCA but it stated "aproved limit"
                      I emailed the letter to you.
                      I will start the PPI reclaim but I'm not sure DI knows what I'm on about with my post lol.
                      I can start the F&F anytime as I should be able to get an small amount from my Mother as long as it's not a sky high offer??
