    I received on March 8th a letter titled Arrears of CCJ as apparently in Summer 2021 a CCJ was filed against me in court. I've had family at this address for at least 15 years, and I've not had problems with post going missing so I know I've not received any court summons.

    I typed and sent a letter on the 14th March a debt "prove it" letter by first class post, I sent this letter because all the letter I received it mentioned that I had to pay £120 a month. There was no mention of who the money was owed to so I asked for that information.

    The debt collection agency solicitors didn't reply to that (they said they were unable to find my letter) so I received a Notice of issue of warrant of control so I replied back to the court saying that the solicitors hadn't replied to my request for information about my debt.

    The day after I received that I wrote again to the solicitor asking for details of this debt they are saying that I owe.

    The solicitor finally did respond and say that they were instructed to collect from a debt collection agency for an account previously held for a mobile phone network. They said that if a contract was obtained online or over the phone that a contract wouldn't exist so they won't be able to provide one, they also said that the client is not obliged to provide me with any documents regarding the debt that I requested.

    On 28th July I received a letter from the court saying that their letter will explain what the debt is about but that is just court fees listed. Also we have had someone knocking from the court twice but I can't accept anything they want to give me until I've had a chance to have a solicitor explain to me what all this means. (I'm hoping to find someone over the weekend that we can speak next week).

    I don't recall ever having a contract with this provider, I've only been with another one for the past 8 years.

    Any suggestions for help or what I should do greatly appreciated

      Apologies for the delay replying, this is causing me so much stress

      My confusion is that I had a contract with another provider and somehow a second contract has been taken out with another provider.

      I asked the collection agency for a copy of the contract and they told me it was taken out online there won't be a physical contract.

      I'm also concerned that as they issued a CCJ (I didn't get a chance to put in a defense) I am being told I owe court fees too.

        If it is with Post Office then they have passed it on to Shell who has passed many closed accounts to several DCAs and others since they closed down telecom dept. They appear to have lost all their electronic data files and are unable to reproduce the so-called bills they say you haven't paid, including the default and assignment notices.

        Seems someone has not done due diligence or is claiming they have when the haven't.

        Currently dealing with one such bottom feeder after another as they are unable to provide any proof that there is a debt - which is disputed - and they just pass it on to a new bottom feeder.

          Yes it's very concerning, the debt agency says that the contract was obtained online so no copy of this exists anywhere, they also say they don't need to provide any other information to me, but I must pay this contract (which I don't recall ever having a contract with as I was with someone else) I am also being confused how they can have a CCJ issued without having to provide a contract.

          The provider in my case isn't post office

            It seems that the CCJ will be by default! But the Court Notice would have to have been sent to you! Seems this wasn't the CASE
