Hiya, Hope you re all enjoying the sunshine, I am moreso now I m retired. I had a reply dropped through my letterbox today...this is the content, and wonder what you think? These people seem a bit more on the ball, but I think the longer it drags on the better for me.

They can't answer you coz they haven't a clue what's going on so chances are, they'll get some kind of response from BH and will go with it on the basis that BH are pillars of the community and always tell the truth about everything (yawn...).

Depending on the content of their next letter.... I may draft up a 2nd complaint about their inability to deal with the first one....

"Suspended" is good though :-)

Spoke too soon...... What do I do now? I v just received a letter from the dlc (Hillesden Securities ). they reply

Black Horse confirmed that all the issues raised have been addressed: therefore we do not feel it necessary to comment any further on this matter.
Due to the above, the account has been returned to our collections team for collections activity to continue.

They attach a copy of the letters Black Horse sent to me in explanation of the errors.... five pages of reasons and excuses.

Which of course I don t accept, but how do you go against these big concerns... Would appreciate your input Priority... its knocked me back a bit ... serves me right for feeling slightly confident

What scares me is reading the comments by sxyguy on this company. That they like to litigate, I am like his mother it scares the hell out of me and my home is my security that I have worked hard for after divorce.

My question is.... This vehicle has been repossessed and taken to auction and sold on. My credit rating is clean and green. Can they take me to court for a balance that I disagree I even owe them given what I have already paid and the questions surrounding the deal?

Gently please, I am worried over this company.

Well, if they do decide to litigate, they'll have their work cut out for them..... because the figures they've haven't been substantiated by anything. In fact their response is extremely vague.... and while they may "not feel it necessary to comment any further", that's not how it works in response to a formal complaint.

Ok.. and thanks Priority, I do panic.... I v been reading some posts by paul on litigation... I do n t really understand how it works, and the meaning of unregulated agreements which BH. hide behind in a lot of their reasoning... See what happens ...

Ok.... I've drafted the letter below for you to send (by rec. delivery) to this bunch, as they haven't addressed your complaint at all. I do understand your panic but in reality, there's nothing more you can do here for now apart from continuing to fight your corner..... If they're intent on issuing court papers, then they will but I'm hoping that they'll consider it a stupid thing to do and not bother. If they do issue court papers however, then it will be the first I've seen in response to a request for clarification under CPUTR, as it's statute law...... so we'll see.

SECOND FORMAL COMPLAINT

Dear Sir/Madam,

Your Ref:

I do not acknowledge any debt to your company and refer to your letter of xx/xx/xx, the content of which has been noted.

As my first formal complaint specifically asked for clarification(s) under The Consumer Protection from Unfair Trading Regulations (CPUTR) 2008, the response from your company that “you do not feel it necessary to comment any further on this matter’’ is dismissive at best. It is also not how a formal complaint procedure works.

I therefore refer you back to my first formal complaint and suggest that you now address the concerns raised within it. If you are in any doubt as to what those concerns are, a synopsis can be found in the letters forwarded to you by Black Horse Finance prior to them attempting to wash their hands of the problem by selling it on to yourselves.

Once again, I require you to clarify the figures sold to you by Black Horse Finance by providing a complete breakdown of how those figures were calculated; from inception until present day, together with supporting evidence to substantiate any lawful claim to pursue me for payment. Please note that failure to do so, even by omission or lack of response, will be regarded as an attempt to deliberately misrepresent or conceal the legal position regarding this matter under CPUTR (2008), to which an appropriate complaint will be made to the Office of Fair Trading without any further notice.

As this account was clearly disputed before it fell into your hands and appears to be an unlawful and invalid assignment by Black Horse Finance for reasons they are fully aware of, I also suggest that you now return the account back to Black Horse Finance before the matter escalates any further. If you are in any doubt as to what an unlawful and invalid assignment means, it may be a prudent move to seek guidance from your legal representatives, who will no doubt enlighten you.

I trust that I have now made my position abundantly clear and look forward to your considered response in due course confirming that on this occasion, you have made a genuine mistake and your files are now closed. Please note however, that any legal action you decide to pursue in the face of concerns raised in this complaint and previous correspondence to Black Horse Finance will not only be fully and vigorously defended, it will also be treated as both unlawful and vexatious.

No worries :-)

The history of yours is complicated. The plus side of that however is that it will be doubly complicated for any outfit brave enough to try and substantiate those figures with all the dodgy record-keeping that's gone on over the years by BH.

That's not to say they won't have a go at going to court with it.... but because we're putting up a big pre-court fight, I'm hoping to spare you that headache. If they do issue court papers though, there are people on here who can help with that too :-)

Thanks , and that's comforting to know. Niddy was right in the first instance when he said I d been shafted... but I v reached a time when I just cannot carry on paying them, and fresh eyes have made me realise, yes I was shafted... in the monetary sense of the word lol ....

I try to get my head around the terms of the agreement, but they seem to contradict....and there are errors and anomalies ( if thats the right word ) all along the way. So hope you re right, I will be happy to get them to just forget about it now.. but I won t back down no matter what now.. else they have won..

I ll get that letter off and see what it brings back

With any luck they might just give it up and sell it themselves, which will then take us into the fun arena of client's clients....

Let's see.
