I tend to take them all seriously... thats why they have gotten so much out of me already,,, but I understand what you re saying and the tone of the letter means business, especially the bit about their research on me..

I value all the comments and will wait until P1 gives me the final word on this, but I did think along the lines of a "sold whilst in dispute" and maybe a copy of the questions and comments we sent to the other D.C showing what my problems with the account are ??

My main concern here is that this is not about UE in the usual sense; it's about BH's inability to substantiate the amount they have outstanding on their records...... so the "sold in dispute" letter may be ineffective.

I've not had time to look at this properly but will find some time tomorrow. DLC need to be aware that if they're going to persist with this, then they'll now need to be able to substantiate these figures themselves.

I agree that a letter needs to go off but in this case, it may need to be adapted beyond a template....

I see... I know this is all a bit different to the usual debts...I have paid for the vehicle.. they are chasing interest, and, it was a dodgy deal...my problem is I don t know enough about the legalities.. I just feel I v been screwed...and... I cant afford the amount they are asking for now..to attach a CCJ to my home sickens me...I just thank whatever for the fantastic support I m getting from here and my partner...

I can't seem to access the Template section at the moment due to site maintenance..... As soon as it becomes available, I'll give the Sold in Dispute template a read.

In theory, it has been sold in dispute because there was a dispute raised prior to the sale of the account but this kind of dispute would not stop DLC from going through the courts, which is why I'm sitting on the fence with it.

If I'm not able to access it, then I'll put something together just to let DLC know you'r no pushover Susie... :-)

COMPLAINT

Dear xxxx

Your Ref: xxxxx

I refer to your letter dated xx/xx/xx; the content of which has been noted.

To date however, Black Horse Finance have been unable to provide me with any definitive answers in response to the the two official complaints raised with them on xx/xx/xx and xx/xx/xx requesting the clarification of a number of concerns under the Consumer Protection from Unfair Trading Regulations (CPUTR) 2008. Instead, Black Horse Finance appear to have now sold an unsubstantiated “balance” to yourselves without informing you of their continual inability to substantiate any debt pertaining to myself whatsoever.

For your ease of reference, I enclose both copies of the complaints raised and respectfully suggest that you now liaise with Black Horse Finance for the answers they should have provided before attempting to rid themselves of a problem on their books by selling it on to yourselves.

Should you persist in your claim to an entitlement towards any alleged balance pertaining to myself after liaising with Black Horse Finance, then I request a complete and precise breakdown of how all figures have been calculated to date under CPUTR 2008, as per my original complaint to Black Horse Finance, together with supporting evidence to substantiate your claim. Please note that any court claim issued by yourselves in the continued absence of such evidence will be vigorously defended. It will also be treated as both unlawful and vexatious on a number of grounds.

Finally, I do not acknowledge any debt to your company and suggest that you now get your facts in order before sending any more threatening letters to my home.

I trust that the content of this letter is self-explanatory and look forward to your considered response to this complaint in due course; confirming that on this occasion, your company has made a genuine mistake and that your files are now closed.

I still think your first comment in BH not bothering with court is something to lean on...but I am no expert..

When you issue a complaint, they need to address it... and I do believe they'll try. People on here have said that they're aggressive, so just because BH wouldn't go to court, doesn't mean that this bunch won't but I'll be able to tell more as time goes on; the tone of their letters, etc.

Seeing as BH weren't able to substantiate anything and decided to sell doesn't really give DLC or any other debt collecting company much hope unless they were hoping to go for a CCJ by default (undefended).

Let's see how they decide to respond.....

Couple of things to remember regarding DLC, as ive said before, they take a few weeks to respond to anything, and generally send out standard template letters inbetween.

So keep that in mind, as you may feel they are ignoring you, but they wont, just wait for a reply.

As agressive as DLC can be, they will address your concerns, i dont like to give DCA's credit, but DLC have always tried to respond to anything ive ever said to them, without using a template letter.

Thanks SXGuy.... I've had similar experiences with Cabot in the past, where the initial letter is quite strong but they have then tried to deal with the issues raised. Can't say that about all of them though. Some of them can be a pain in the rear for a while before they eventually feck off.

Hiya, Hope you re all enjoying the sunshine, I am moreso now I m retired. I had a reply dropped through my letterbox today...this is the content, and wonder what you think? These people seem a bit more on the ball, but I think the longer it drags on the better for me.
