So BH have bottled out and sold it at last......

I have not dealt with Hillesden Securities personally so am unfamiliar with the kind of games they play.... At this point, I would suggest waiting for their next response before responding.... at which point, we will refer them back to BH for the kind of definitive answers they're gonna need to justify chasing the amount they're chasing.

Yes ...thanks will do that... its a small amount compared with what I v paid already but nevertheless I feel they have had their pound of flesh.

Its opened my eyes... this letter is from the same place from two different companies ??

Well I thought it strange that it was in the same envelope as the letter of assignment from the BH..The letter came from Bristol yet Hillesden S is in Northamptonshire...Both dated 5th June

The cheap and nasty NoA is just par for the course. Usually, they are forged by the assignee.

Would they do that?

Bristol is a sorting distribution centre, usually up the road on the A4 (TNT depot maybe) like many around the country = specialist churn out companies, so ignore where it came from on envelope.

Yes .. you re right... but I did nt understand why BH and this DCA sent me a letter each in the same envelope, dated the same day... Its like one big game... I m not as worried as I was when I first started on here thanks to the support and knowledge on here.

That is what happens virtually every time an assignment is made. We've all seen it many times before, it is nothing to worry about, it is all perfectly routine.

As it is an absolute assignment, which means the alleged debt has been sold, Black Hearse are no longer in the picture. What it also means is that the wrongs which have been committed in the past can no longer be corrected. The buyers have not carried out their due diligence, and have bought something which is fundamentally worthless to them.

Hi....I ve just had an early birthday letter.

DLC say they have it on good authority I own my house, and as I have not paid they are going to commence legal proceedings against me.Once the county court judgement has been obtained a further application will be made to secure this debt against my property by way of a charging order. Legal costs and charges will be added to the balance.

Must admit its scary stuff... but would like comments please especially P1 if you re around. I presume I send them a letter referring them to the crap account management by BH and Don Amott? a copy of the one I sent to the other DC ?

So would appreciate guidance...Iv gone this far now with the a**holes, must admit its a good scary letter..

I must say that it is very presumptious of them to already know the outcome of a court case that may not even happen! How do they know what the possible outcome could be? Utter rubbish....

I have not read enough of your diary to get the full picture but it appears that they may have bought a dead duck...... one that if it ever did go to court, Thats a big IF, Then the court may well be unable to pass a judgement because the necessary procedures have not been followed and cannot really be put right now that it has been sold ect.

Im sure someone more familiar with this case would be along soon but having read your last post, I didnt want to read and run as it were

Thank you Spud, thats what I like about this site, people genuinely care and have such good insight. My debt is small in comparison to others,but I really feel they have had their pound of flesh. I am retired now, and obviously any money I have is not for throwing about needlessly.

I m into my second year of not paying anything, my partner supports me and convinced me to put a stop to this. The debt is interest on a repossessed vehicle that is now probably scrapped , its no longer on my credit file.There was a lot of jiggery pokery, (as my mum used to say)when the finance was started between BH, Don Amott (dealer) my ex and solicitors..the letter today did scare me at first.

I think I need to throw "sold in dispute" and all the queries I have ..back at them. just want to be sure...

Hi Susie,

I'll have a proper look at this at the weekend if that's ok... :-)

They'll need to have their ducks in order before going to court with this and since BH never managed it, I don't fancy their chances much.

Try not to worry.... :-)

**Edit** I thought is was Hillesden Securities chasing this? Are they connected to DLC does anyone know? Sounds like another one of these client's client's client jobs.....

I wondered about that.. re the name... on this letter it says..

Client ; Hillesden Securities Ltd. formerly Black Horse Ltd

the letter heading is dlc... direct legal & collections..it says in small print at the bottom.. dlc is a trading name of Hillesden Securities..

Oh right.... the next desk along then....

As it's been sold by Absolute Assignment, they could try and go to court with it. I was pretty sure BH wouldn't and doubt DLC will providing they're tied up in enough knots to give them migraines. They won't know the history of this at the moment; it's just been bought as it is..... so it's down to them to get the info. from BH, which should be fun!

I've not dealt with Hillesden/DLC on a personal basis so cannot predict which way they'll go at the moment.... but it shouldn't take long.

Ive delt with DLC quite a lot over the last year or so.

The letter you received regarding obtaining a CCJ and Charging order, is a standard letter they send to all new debts they buy.

Thats not to say they wont actually try for a CCJ and Charging order, because they are known to do this with people who dont know what they are doing.

So my advice would be to respond to this letter and take it seriously.

I havent had a chance to go over your thread to see where you are at with this debt, and whether its UE or not, but the first thing you must do is make DLC aware of any issues regarding the account, put them in the picture.

I would also not be too soft with these guys, you need to be firm in your conviction.

DLC take around 2 to 4 weeks to respond to any letters so its likely you will get there machine generated template letters inbetween replies, be prepared for that.

They do also like to send out letters threatening action from their personal solicitors regardless of the state of the account.

I have sucessfully managed to see those muppets off with a creditor refusal to accept UE, and got DLC to admit it was sent in error.

But they are persistant, they do not give up and as far as im aware very rarely sell their debts on, so how you go from here is vital.

That all being said, i am 1 year 6 months down the line with these, so although id be caucious of their threats, please dont stress over it.

I think you should send them account sold whilst in dispute to put them in the picture, and send them a telephone harrassment letter at the same time.

One thing i will say about DLC they have stuck to their word and stopped telephoning me for over a year.

Hubby was two and a half years down the line when Hillesdens issued claim after months of inactivity. Just tread carefully.
