The "Sold in Dispute" letter won't do any good here as the account has not been sold, so if we're going to use a template, it'll need to be adapted to suit. I'll take a look over the next day or so.

My thinking is that BH will sell this account eventually but for now, they're hoping to put the pressure on by farming it out to different companies. They made it clear earlier on that they weren't considering going anywhere near a court with it, so it looks like it'll be a game of letter ping-pong before they finally give it up.

Unfortunately, this means that things could drag on for quite a while....

Susie.... please can you go over BH's letter with a fine tooth comb, list any contradictions that spring out.... and, any discrepancies that you can still find that they've attempted to dodge answering. We will then take things from there.

I would like to point out that a formal complaint was raised with your client on xx/xx/xx regarding a number of inconsistencies with the account in question. To date however, your client has failed to provide a cogent explanation. 



As your company has now been “instructed” to pressurise me into making payments based upon the extremely dubious transactional records that they hold, I respectfully suggest that you liaise directly with your client and return the account from whence it came because I have no intention of telephoning you to discuss anything.

I would also respectfully suggest that you advise your client that until such times as they are able to address the concerns raised in my formal complaint, that no further payments will be forthcoming to anyone.

A. Not sure of what unregulated means.
Why is there a place for deposits and part exchanges on the agreement if it’s not required?


B. The dealer's invoice dated 12th May 2002 referred to deposit of £1,917.46 plus a balance of £4,112.50. The total price of £34,029.96 less these amounts results in the advance of £28,000.00, therefore the deal agreed between our customer and the dealer did include some form of deposit. Furthermore, since the invoice referred to the ‘contra‘ (‘contra’ relates to the settlement of an existing finance by a new agreement through the same finance provider) of 585791185 an existing hire purchase (585791185 - Sterling Europa
480) was settled by the new agreement. Our records confirm that a settlement amount of £5,740.76 was used to close 585791185. Therefore if the sale price of the Sterling Europa was higher, an element of part-exchange may have been incorporated into the deal. Your correspondence stated that a Kia Sportage was also used as a part-exchange and on the basis of the evidence available it is confirmed that at least one part-exchange was included to facilitate the purchase of the vehicle financed by 511089254. However, I would reiterate that our company was not included in the negotiations between our customer and the dealer and commenced 511089254 on the instructions of those parties.

This invoice only came to me through the SAR> I don t know where the deposit came from but the main thing is that the caravan (and Kia) were settled without any signature or agreement from me. BH financed the caravan and I have a copy letter (also via SAR) from BH to D.Amott settling the finance with a settlement credit of £1000. He is presuming a deposit, seems unprofessional, but hides behind this signature on an unregulated agreement. Sound like loan sharks if they absolve themselves like this.
I am going to query the £6417.46 not vat extras and also the fact they used vat in the calculation of the invoice, as this vehicle was vat exempt (disability)




C.I presume that the letter referred to in your correspondence was that dated 10th May 2002. This letter was ‘a-settlement quotation and confirmed the amount required to settle 585791185 (please refer to point b).

This refers again to the caravan and I thought of asking for proof , where is the authorization to pay this to DA and close the account, and again there is a debit balance, I never received it.





D. The invoice dated 23rd March 2002 was received on 9th October 2012 as part of an e-mail from the Finance & Leasing Association. This invoice did not form part of the documentation used to commence 511089254 and is not considered part of that contract. The invoice in question does not refer to Black Horse and appears to be a sales agreement between Mr Cadman and Don Amott Leisure. Presumably that sales agreement did not proceed as the purchase of the vehicle was completed via the finance provided by 511089254 using the invoice to Black Horse dated 12th May 2002.

This refers to the agreement my ex signed and I totally disagree. Its got reference to BH and the vehicle all over it. It states it is a sales agreement and the vehicle is VAT free. Again my ex signed the agreement. I don t accept that BH should absolve themselves completely like they are doing.

G. Refers to the comments we have made on how they calculate their interest and payments. That on a 10 year agreement I paid off £32000 in two years on goods with a cash value of £28000 and they have been chasing interest this past 8 years. To get their full total of £40k.
I would appreciate your thoughts on how these things are calculated. Surely when a large amount is paid off in a short period some interest is knocked off. Again they hide behind this non regulated thing..

K . Reference to the 2 differing agreement documents. I had neither, they insisted on letting my ex have rights, stuff was sent to him that I did not receive, I had my signed agreement that was all, I was not advised in any way about what it all meant. I know on hindsight I was naïve and stupid , but I was in a bad way, and wanted back into my home with my girls. …

Susie, after thinking about things.... I'd be inclined to just send a copy of the letter in post 186 to BH, for the time being at least.

We could bash this one out for ages but they're still not going to give you the direct answers you're after. They're well aware of the dispute and since they've made it quite clear (so far) that it won't go to court, their seems nothing to worry about other than letters from whoever they're hiring to chase you.

Hmm. We have just been discussing just the same..I think you re right, its a right mess and you have been really supportive. I think also they know where the fault lies. My partner says that if they wanted to take me to court they would of done so by now, and thats what was scaring me,I get wound up everytime they reply ... and I end up with a headache lol..... BH have given me additional information to confirm that I was shafted by others....

So I think you re right, I will bat back with that letter and sit tight

I ve just received this letter from Apex threatening me with a home visit. I sent the letter P1 wrote last Tuesday, so looking at the dates I think they have crossed in the post.

What do you all think, I really don t want someone knocking on my door, thats dispicable. Why cant these people be more reasonable and see me as an individual who has a genuine gripe.

I thought.... wait a bit to see if they do actually respond to my first letter...
