    FORMAL COMPLAINT

    Thank you for your extremely quick (and final) response to a complaint addressed to your agents; Aplins. It is clear from the extremely swift response to a complaint that was not even addressed to your company that you have not bothered to respond to its content properly, or at all. In fact, your “findings” leave me somewhat bemused.

    Firstly and as already mentioned, the complaint was addressed to Aplins on this occasion but rather than deal with it themselves, they appear to have passed it for you to play around with in yet another chapter of this ridiculous farce.

    Secondly, all clients and agents to date (including your company) have been made fully aware of an ongoing dispute with Black Horse Finance (BH) since 2012. Each and every letter attempting to brush things under the carpet as a final response by BH or otherwise has been responded to. Since BH were unable to answer those concerns, way back in 2012 however, they decided to sell a disputed account to yourselves instead; a dispute that you were made fully aware of, by your own admission, but preferred to take the stance that everything was hunky dory because it seemed to suit your agenda much better.

    I would however like to express my thanks for re-confirming that it was “clear that the account was in dispute prior to acquisition” as this is the crux of the entire issue. Furthermore, since by your own admission, you have known about the dispute(s) raised with BH from when you first started perstering me for money, then your company should have made arrangements to return it to BH for them to address the dispute properly under the Consumer Protection from Unfair Trading Regulations (CPUTR) 2008, as requested, instead of assuming that I must have a screw loose and accepting any old tosh that BH decided to tell you in an attempt to absolve themselves of any responsibility.

    When a request is made under CPUTR 2008, it is not for you or any other set of clients and agents to rely on feelings to justify a campaign of harassment for money, especially when the unsubstantiated nature of that alleged debt purchase has been pointed out to you time and time again. How you “feel” about BH’s response to the concerns raised in my correspondence to them and to you is of no consequence and until such times as those feelings can be substantiated with facts; detailing a complete breakdown of figures from inception until the sale of those figures by BH to your company, I doubt that any court will be interested in how you “feel” either.

    As you imply that you have copies of all anomalies raised in correspondence with BH back in 2012, there should be no confusion as to what these are, so please stop messing me around.My request under CPUTR 2008 for full clarification and a complete breakdown of figures from BH since inception still stands. If you do not have copies of all correspondence between myself and BH, then I suggest you get hold of it before coming out with more inane comments.

    I might also suggest that you do not attempt to cherry pick extracts of CPUTR 2008 and/or then expect me to explain them to you. I am sure you are aware that CPUTR 2008 prohibits unfair or aggressive commercial practices (among other things) that are intended to mislead consumers and effect their choices, either by misdirection, misinformation, omission or undue pressure. If you need to be sure of anything else, I suggest you read the legislation for yourself. While you are at it, you may also want to look at The Consumer Protection (Amendment) Regulations 2014, which amend the existing CPUTR 2008 to give consumers a new right of redress against businesses who conduct aggressive or misleading practices which have a significant factor in a consumer’s decision (in this case) to make payments. This includes debt collectors, like yourselves, who purchase accounts from creditors with poor lending agreements and anomalous records and (knowingly) continue to recover alleged debts under the terms of these agreements and anomalies; tantamount to an unfair commercial practice. At this point it might be worth remembering that consumer credit licenses are only given to and retained by those who are fit to hold them.

    Should you decide to engage another set of solicitors, then please be advised that a formal complaint will be raised with them as well in due course. Should you decide to re-instruct Aplins however, then please be advised that a second formal complaint will eventually surface referring to their failure to address the first one. I have no interest in contacting the Credit Services Association as you suggest and needless to say, still do not acknowledge any debt your company, clients, agents, clients’ clients, clients’ agents or anyone else.

    As your complaint is a “final” one, and I have made my position perfectly clear on numerous occasions over the last two years with a plethora of clients and agents, I suggest that you now consider your position very carefully.

      Nice to see a well-written and accurate bespoke letter on the forum. Excellent stuff.

      The only thing I would change is the start of the end paragraph, to say “As your response to my complaint is a “final” one,” (with a comma)

          Thank you so so much for that Priority, you re a star in that cloud that hangs over me ...

          I often think... oh they must be right.... sometimes...but then check myself....

          They don t seem to "get" that I am questioning how the whole deal was put together in the first place, or rather they prefer not to. I re read one of their letters which said " they have never denied there were part exchanges and deposits. Which they support with that agreement does not legally require them to declare it so. Someone has to be responsible and it seems this new credit thingy you mentioned (which I will read now) acknowledges just that. I was not made aware of what I was signing, they were too eager to get my signature and money and be rid of me. They knew my situation and I was also advised by a barrister I was onto a good thing by signing up for it !!

          Also , the aggressive bit is also true, I was coerced into cashing in an endowment policy to pay them another chunk of money. That would of paid my mortgage off by now, they did this under threat of a ccj on my house. I stopped ringing them when I was told that the debt would never be paid at the continued rate, and I needed to increase it or suffer the consequences. That man was vile, and made me feel the lowest of the low.

          Anyway its in the past, and as long as I can keep them off my house and pension I will be fine.... again thank you so much for your support and just off to Tesco for some ink !!!

            Well, I can't promise to keep it out of court Susie but let's see what happens......

            It boils down to whether they fancy their chances in court or not based on what they've got.... or think they've got. x

              I know..... you ve done far more than I ever could on my own....14 years is a long time for them to be chasing me... bet the thing is scrapped now lol....

              I would just need to find a sympathetic good solicitor that don t rip me off..... I ve had several of those along the way...anyway.... lets see and thanks x

                  Well .... received this reply this morning. It seems these people are pretty sure of themselves. What do you think of it, and more important, what do I do now? Must admit they are starting to unnerve me but I v gone too far now to give in, besides, I don t have what they are asking for.. I am sure they are not in possession of what and why I am complaining, its not as straightforward as they seem to think. Would appreciate thoughts on this now... thanks.

                    It's just another typical load of DCA drivel.

                    All it does is keep reinforcing their previous “stance”, without doing anything to address the points you have raised in your last letter. It is a total non-response.

                    This is what is known as “attrition warfare.” They are simply firing off the same rubbish over and over again in an attempt to wear you down. It doesn't strike me that they are “sure of themselves”, it strikes me that they are saying nothing because they've got nothing to say.

                    They stick to their stance, you stick to yours. Only one of two things can happen – they pay money to take their chance in court, or it eventually goes SB.

                    As they've issued a “final response”, take it to the FOS.

                      It's a bit of a nothing letter, to be honest Susie. As far as they're concerned, they've addressed all disputes, although I'm a bit puzzled by the comment "all disputes were addressed prior to our acquisition". Yeah right..... That must be why they couldn't comment about anything prior to acquisition..... lol.

                      Basically, they cannot confirm the figures they've got..... so have sent you an A4 page of drivel. Just ignore it and see how their "Litigation Dept" decide to "manage" it and which solicitors they'll try and turn to now.

                      I have no faith in the Financial Ombudsman myself and think the Financial Conduct Authority would be better because DLC have continually fluffed around the CPUTR issue. If they do issue court papers though, we'll complain to the lot but for the time being, it's all about how confident they feel about not misleading you under CPUTR..... when it's clear that they have.

                            Thank you both, a bit reassuring, and you help me see the other side of issues. So I will sit and see, it will be interesting to see who they give it to next .

                            For reference, I have been to both FLA and FOS who did the "Ceaser" act, washed their hands and said it was not in their area of reference, they could n t handle this particular issue. FLA were nicer , they rang me and more or less apologised and advised me to go to the FOS or a soliciter, which I did ( this was pre AAD), and again they could n t help.

                            So you guys are the only ones who have given me realistic support, as over the years I have tried to make sense of this debt whilst dipping into my purse. It might be the last 5K of the so called debt but I have no more to give and now more than ever think I have been generous enough for something I never even rode in.

                            So when these vermin try to tell me its been addressed, that the Ombudsmen have dealt and agreed, they are stinking liars, because I have letters that say otherwise.

                            Rant over and waiting game now

                                I do, they re the best support I ve had and this is a very old debt, BC...before computers... well just about.

                                ..I know that at best it will be letter tennis but I can cope with that...... If I don t have to pay the balance, which I cannot afford now I shall be happy.
                                If I win the lottery I would take the ^^^^^^^^ to court because it was all one big scam....
