      Hi

      Just a quick question.

      As I explained before, BG has never responded to my CCA request and, according to the Post Office, they have not accepted delivery of it as it is still being 'processed through their network for delivery.'

      Therefore, should I send another request to BG or just keep responding to whichever DCA has taken on the debt that it is in dispute and ignore BG?

        As you have proof of postage then you can assume they have taken delivery of it being Royal Mail do not classify recorded delivery the same as special so the website isn't always up-to-date.

        basically, you have proof you sent it so you have to assume they received it - usually when a company gets recorded delivery items royal mail batch them together and obtain one signature for the batch - so say you worked for a large bank, such as HSBC in the postal dept - on an average day you'd probably get 100 recorded items and so to avoid you standing there with the postie signing 100 times, they batch them into one parcel and get one signature - it is these that never show online, however it does not mean it was not delivered.

        basically ignore them as they are in default of your lawful s.78 request and therefore cannot take any action against you/the debt.

          Yes, that makes sense as I am sure that Barclaycard are getting many of these letters each day!

          So, will definitely keep hold of my proof of posting - perhaps I will laminate it for posterity!

            My SAR was the same to Barclaycard 'processed through their network for delivery.'
            As Niddy know's I panic so I sent another with another tenner in it and that did the same. Then I got the response to my SAR along with the tenner postal order for the second SAR I sent.
            It's there don't worry..

              I have had a letter from Barclaycard basically saying they cannot find a copy of the credit agreement and although they cannot enforce the agreement they can take any action short of enforcement.

              They go on to say this includes informing credit reference agencies, default notices, demands for payment and instructing a third party to demand payment.

              They also cite the case of Philip McGuffick v The Royal Bank of Scotland (2009) EWHC 2386 as it was held that none of the above steps constituted "enforcement" (their quotes) for this purpose.

              I have scanned the letter which I am happy to send you, but as it is obviously a standard letter I expect you have seen it before - perhaps many times!

              I assume that I just keep quiet until I hear otherwise from 'a third party!'

                  NEW CCA Query - Letter Previously Confirming No CCA

                  If you hear from anybody just send the above, along with a copy of that letter from Barclaycard keep that letter safe

                          Just an update and, hopefully, a confirmation that nothing has changed regarding the unenforceability rules.



                          Type of account: Goldfish Barclaycard
                          Date Comnenced: Many years ago when was just Goldfish
                          Approx Balance: £11,600 at start now £12,600 after interest and charges
                          Date last Paid: August 2010
                          Arrangement: Not pay
                          Status: Default
                          Owner: Apex (see below)

                          History:
                          CCA request 8/11/10 no reply
                          Letter from Mercers Nov 2010 - sent response as per Niddy's link above on 3/12/10
                          Letter from Calders 11/2/11 - sent same letter 18/2/11
                          Letter from Credit Solutions 28/4/11- sent same letter 3/5/11
                          Letters from Apex 29/6/11 and 8/7/11 - sent template letter + copy of BC's letter that they can't find agreement
                          Phone calls (not answered) and letter from Apex dated 14/9/11 requesting payment (same letter as first one received from them).

                          Was going to send the same unenforceable template letter and copy of BC 's letter, but thought I'd find out if anything has changed regarding the unenforceable route that I should be aware of.

                            I would just ignore them for the minute, they are a bit thick and appear to be having trouble reading your letters.......................
