    Re: Removed from files

    Next instalment :

After sending a letter to CSL informing them that no CCA has been produced, I've just had a very strange letter from the actual lender Lloyds TSB.

They apologise for not sending the CCA but have did not receive my request - probably because it was made to Robinson Way. But have instructed there card services department to send me the required info to meet their obligations under s78.

Bearing in mind the DCA (Apex) informed me in writing that the CCA no longer exists as it go back to 1987. What do you make of all this?? Hope they don't find the CCA !!!

Should I respond by sending a copy of my original request to Robinson Way or just wait until anything turns up??

Have received another letter from Apex and this time they have confirmed that due to the credit card being opened in December 1987 the agreement no longer exists. They then go on to say that I should contact them if I wish to discuss this further.

I assume this is the result we've been looking / hoping for. Do I need to respond or just sit tight ?

I've had a letter exactly like this on an account from the 70s! Scanned it and saved it in my email account and on my hard drive and filed the original somewhere safe.

the account just went around the DCAs and now i just get a monthly statement (even though no payments have been made).

          Re: Removed from files

          Hi

Had letter(s) today in the same envelope from Lloyds and 1st credit. Lloyds have sold my debt to 1st credit.
          1st are demanding payment.
As they are the new owners of my debt, do I need to do the whole CCA / £1 request again or can I just send the usual 'account in dispute' letter??

Thanks - thought so but wasn't sure when a debt is sold on.

Don't worry too much about LLoyd's, sent mine around 7 different DCA's. After they had acknowledged that the account was unenforceable!

I'm about 3 weeks away from my Lloyds account being Statute Barred - the account has been passed back to Lloyds and they appear to have given up. Just stick it out and I hope it will end up the same way as me.

                  Regards.

God, one of the worst things about this is having to cover yourself by sending the letters recorded delivery.
Just spend 45 minutes in a post office queue - nightmare !!!! (but a necessity).

i have query regarding SAR and wonder if you can help?

I made a SAR request out curiosity to see what they have on this account.

Lloyds have asked me to either sign a form to get the paperwork sent to me or collect it from a Lloyds branch (where i'd also have to sign for it).
I don't want to give my signature and don't see why they can't post it to my address. Do you have any suggestions for getting round this??

Although it is not a requirement, they do play silly games. The way I dealt with it was to use a signature that I have never used! They have never checked.

                                Hi all

I sent an 'Account in Dispute' letter by recorded signed to 1st Credit for on 9th Dec, but it is showing an still undelivered/ can't deliver on the RM tracking service.
I've now had a 'strong' letter from them threatening court action.
I noticed that 1st Credit address is a PO box number - has anybody had problems getting recorded letter delivered to PO box numbers or 1st credit??
I realise it's 'that' time of year but what I don't want is for them to bang off a county court claim that i'll have to defend.

Should i re-send by ordinary post ?? and suggestions welcome.
