    Quick query folks, two debts with Halifax, do I send 2 separate letters with £1 for each? I have printed off two separate ones and put in same envelope but not sure about amount.

          Ok letters now sent and DMP cancelled so no payments going to creditors. We wait to see what comes back.

          Have I read right that next stage is emailing Niddy copies of CCAs when they arrive?

              You won't need luck! One important thing nobody has mentioned so far is to stick to the exact wording of template letters. They've been very carefully worded.

              Well done on cancelling CCCS, that one step makes this move worthwhile. You can do more by yourself than they will ever do for you.

                Thanks everyone. I know you are all there for support but I'm just a little nervous I have to say

                I do think the Halifax cc may well be UE but don't think the others. Any idea how long it can take to default me? Or am I asking how long is a piece of string?

                  Thank you I have stuck to the exact wording but I've had a look at some of the templates and it mentions English law, I'm in NI so are there templates for this jurisdiction? It was the harrassment ones I'm referring to.

                    That's a good question, and one I can't answer. However, I've helped people from NI and have used letters from this site without any quibble back.

                    I guess we'd have to go to the precise piece of legislation questioned to answer correctly, so we can see in which jurisdictions the law applies.

                    As I'm sure you know, some cover E & W, some E, W & NI.

                      I'll just wait and see what letter I need to use and if it needs to be tailored I guess it can be looked at before sending it or if the creditor is based in England maybe it still applies? Anyway, will cross that bridge when I come to it.

                        Can understand that but how about this back in 2009 I was taken to court by MBNA/OPTIMA LEGAL it was at a time my dad was gravely ill with cancer and in hospital very much on his last days.

                        My dad past away on the 9th April 2009 and his burial turned out to be on the same day I was due in court I had just two weeks to get this postponed so I wrote to both the court, mbna and the solicitors optima legal.

                        MBNA wrote back saying it was in optima's hands, the judge said he would agree but I would need the permission of optima legal first as it was there case. I had no reply at all from OPTIMA LEGAL they just sat on my letter and did not action it with me or the court.

                        I end up going to the court the day before trial armed with an N244 seeking the judge to make a decision due to optima failing to act I was quite rightly furious the court manager was very good and put my n244 before the judge straight away and luckily it was actioned however I should have had to go that far.

                        That debt of £7.5k I am paying just £20 a mth and it stays at that as the judge made note of optima's poor handling of the case and thus there are no terms to increase, considering I offered MBNA £50 a mth pre court that for me was a good result.

                            Yes it was which is one of the reasons I support Niddy as he does a damm good job of keeping citizens out of court.

                            I never ever want to be in that situation again Optima Legal are swine's and will break every CPR in the book if they can get away with it.

                            I will praise the day they lose a big case in court and that day will come sooner or later.

                              Ermmmm have you sent CCA's yet?
