      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

      If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

        Hi

        It's now the 3rd July 2012 and to date I have not heard anything from Fairfax, or anybody else for that matter, on my request for the CCA.

        I think its a bit over the 12 days allowed, does this make the debt unenforceable or if they still come back with a signed CCA would it be enforceable even although they clearly didn't reply within the timescales.

          It's unenforceable untill they send you a CCA which is enforceable. I Would just sit tight for now.

              Hi

              Received my reconstituted CCA from Fairfax on Monday 24th July 2012. Have mailed said CCA to Niddy for advice.

              Just one question and I know it may sound stupid but does the CCA actually have to contain your signature. The reason I ask is that the CCA I've received does not contain my signature anywhere. However, where my signature should be is a box, and of course ticked, with the words "I confirm that the tick in this box is a valid means of establishing the authenticity and integrity of my signature to this credit agreement. I understand that MBNA will hold this acceptance data on their files".
              I don't remember ticking the box but then again my memory isn't the best.

              Personally I would have thought this was a bit dodgy as anyone could tick the box and make you liable for the debt, but I will bow to Mr Cools better experience.

                  Just to say thanks for all your help and advice. Unfortunately my agreement is not UE, the tick box was ticked, and so its back to the negotiating table with Fairfax and try to arrange some sort of payment I can afford.
