    I have now received a further letter from Lowell with an alleged true copy of the original CCA giving me 10 days to send my proposal of how I wish to pay.
    A couple of weeks before they wrote saying that they could not obtain my CCA from Capital One and the account was closed as Capital One do not keep records that far back???
    I have sent a copy of the CCA to NiD but I am confused as to
    a) How they can suddenly obtain a CCA when two weeks before it was nowhere to be found
    b) How can they give me ten days and not post the letter straight away
    c) The date on the alleged CCA has been stamped on and is not when the the card was applied for.
    Bizarre!

      It'll be a recon. Basically they can cut n paste info on it using data at hand.

      HSBC v Carey sorted that farce. I'll check the recon later

                Problem. Can you prove it?

                They provided a signed agreement with a date stamp of 2007. So......

                Any bank statement etc to show older payments? Do you use the same bank now, you had back then? (ie SAR)

                It's obvious they cat an pasted a signature on that form but can you prove they did that...?

                      Actually no I'd not SAR at this stage.

                      Instead send missing PT's template.

                      SAR later "IF" things get out of hand but it's clearly a recon and not accurate as the late payment fee for example, is wrong

                      Plus lots more including the whole agreement!!

                          Letter received today

                          I sent the missing PT letter last week. Today (crossed in the post) they sent a letter urging me to contact them urgently. I am in no hurry a I will wait until they respond to the missing PT letter.

                            you've asked for a CCA, they haven't produced the proper paperwork, you've sent a letter pointing this out

                              Thanks evenlessdopey. I intend to do that with the first one but the second one is a complete blag. Its only £178 but did not like the guys attitude and threats so I am dragging it out as far as I can I want to see what they will do over £178
