        Some questions

        Thanks DI that helped a bit but id like to get some more info

        I assume there was PPI on this loan?

        I assume the contention is it was missold?

        If i am right then can you let me know what grounds it was missold on please?

        Also can you let me have the figures as they appear on the agreement and also can you tell me if it is secured or unsecured?

        There are different rules for regulated secured loans than for unsec

        Once i have this info ill check the agreement

        also can you tell me the date of the agreement

          Yes and the way it was sold to us but PPI is the main issue

          It was not added on the Application made by the broker Click Finance, I have a copy of this if you need me to send it to you, the Application orginally was for £21K over 240 months, but the loan agreement/Endeavour it has both loan and PPI was added on there, term 300 months, it covered just the first applicant only, so my hubby and not me, but I was still left responsible for the whole loan including PPI yet it would not cover me, as the broker/introducer did not mention the ppi or it wasn't applied to the application form, it seems it was added later on in the process so then we assumed it was all part of the package of the loan, and my husband has pre med conditions of a back condition, infact the loan was just sold to us when hubby returned to work from being off sick because of this problem, there are notes here by the underwriter as well so they know about that.

          Also can you let me have the figures as they appear on the agreement and also can you tell me if it is secured or unsecured?
          Loan £21K and PPI £2835

                So to get this straight,

                (oh btw the copy agreement you sent i cant read the words on it)

                you went to a broker to arrange the loan.

                You never asked for PPI at all.

                The first time you saw the PPI was when you were sent the agreement?

                did you pay the broker an arrangement fee to go find you the best loan for you? or did you ask them to go specifically to this lender and arrange the deal?

                i would also need to see the terms and conditions overleaf and any PPI terms supplied.

                  It's rather small and some parts are unreadable.

                  It's a strange one really, it was our very first secured loan, so i lacked knowledge then on how this actually worked.

                  There is a lender agreement that was signed on 7 July 2004 (Endeavour personal finance) before the Broker application taken place afterwards where we signed the loan application on the 16 July 2004.
                  Our signed agreement was dated 30 July 2004.

                  We cannot recall on this and do not even remember the insurance matter being raised with the broker during the application, and that is correct in regards of the PPI it was on the Endeavour lender Agreement (that's when we assumed it was just part of the package, with lack of knowledge of these loans then) and the terms were different to that of the application form, which makes us think now if they extended it to 300 months with ppi so we would have been paying the same as if it were 240 months without the ppi).

                  We understand through research that the lenders Endeavour had an agency agreement with these, so Click Finance the brokers were Introducers, Introducers would therefore do the work and not give advice to the customer/applicant and they would do all the instructing for the lender, so on completion fees would be paid from the lender to the broker.

                  I did post up the T&C's on one of the above posts, but do have a separate policy in regards of the insurance, with the logo Endeavour and the insurer/underwriter those of Hamilton Insurers details enclosed.

                  So we are wondering if in this case the lender made arrangements with the insurer and the broker had no involvment in this part of it, the problem we have here though the broker/introducer dissolved in 2006.
                  Let me know if you want me to post up the PPI policy details booklet, I shall do so at some point today, cheers.

                          Terms are clearer now....

                          However one point to notice here, these are a mock-up. Look at the numbers 1-9 then 8 instead of 10?
