They basically said that i have no claim for financial hardship, in their eyes the Nationwide did all they could to help me. and they are not going to accept my claim. I advised them that I contacted the Nationwide of my financial difficulties but they claim the nationwide did not receive any communication from me even though I sent these by recorded delivery. they claim that the Nationwide did not receive any letters from Payplan advising that i was starting a DMP. The FOS advise that they have no obligation to refund charges to customers who are experiencing financial difficulties
I don't really know what I should do now as they are not budging I am suppose to reply by the 16th August

This is normally the case.
It needs arguing as you have proof of servicing, you also need a letter from payplan confirming the dates they wrote and a copy of these letters and build a defence. We can't do it, you need to.
I'm having same issue (niddy vs opus) where the FOS sent 4 sets of documents - none received. Ive quoted cpr's and other laws at em suggesting it's crap. The FOS agree but I allowed extension as the bank would just appeal so this is quicker. Point is, you sent stuff recorded so get proof lol

The Adjudicator wrote to me last month and said she was rejecting my claim. I wrote back to advising that I was not happy with the decision. They then wrote back saying the same thing and they have given me until 16th August to respond.

just to be clear I haven't sat on it for three weeks I only received the reply last week and they have given me until Monday to respond.
this is the second letter from them advising me of their decision, the fist response I got, I asked them to extend the cut off date due to my husband being in an car accident she extended this and I gave my response and she still would not upheld it

I am just re-reading it now and it says they received my letters but nothing from payplan regarding what repayments I may be able to afford. and this is the reason I continued to received collection calls from the debt collectors. they advise that I have been making payments towards the debt since April 2010 but these payments have not been made consistently and no formal repayment plan has been agreed with Frederick International

Appeal to the actual ombudsman and send the proof you have. Maybe payplan messed up?

This is standard procedure, it was the same for mine as well.
Twice I received these letters from my Adjudicator, the one was because he could not continue because he could not link up all parties involved in my case, he gave me about 2 weeks to send in any further submissions/paperwork and did also give me the opportunity to ask for more time, so I think it was a further week he gave.
I then sent in further info - these were the details of all parties involved in my case, he still failed though to see through my case despite sending him "concrete evidence" he asked for. So we received yet another letter, and then he said if we didn't agree with his decision, we could have it fully reviewed by the Ombudsman, so I emailed him straight away and told him we didn't agree with his decision and send further submissions by the 5th of August, this was the date he given (he did also previous say we could have more time) and if we require this to let him know.
But we managed to get in the submissions on the deadline date.
He got back to confirm he have received our submissions and it will not in due course be fully reviewed by the ombudsman, and the usual it will take some time due to backlogs & High volumes of complaints.
But he did also say in that time he is still giving us the opportunity to forward further submissions by the 29th August.
Long and twisty this, but that's the order this have worked for me.
