Just checking that you did include the £1 fee with the CCA request to Arrow?

Keep on your toes with Restons. They use pompous language to confuse and confound. I would not buy a used car from them. Once they pulled the wool over my eyes and well and truly lied to get their way. Having found this site, use its experience to defend any claim.

Hi, I have received a reply from Arrow Global They have said that they are not the creditor but will obtain the documentation from the creditor. They have said that collection activity is suspended. I am still paying Restons £25 a month, shall I continue with this and also do Arrow Global have a time limit to produce the credit agreement? Thanks in advance for your help.

14 days before they're in default. Don't worry. Longer is better

                Re: Restons - Charging Order

Typical Restons and another perfect example of why DMP's and payment plans do nothing to help anyone. Pay for months/years, think that you're getting back on your feet, the defaults with the CRA's start to drop off and then some lowlife like Restons then screw you over for a further 6 years (or longer) by applying for a CCJ.

I wonder how many people would agree to payment plans if they were advised from the outset that this scenario could happen. But I'm going off topic so apologies, just this sort of spiteful vindictive behaviour incenses me.

MellyJ - you're in great hands, lets see what they send you in return, and hopfully they'll be in a bit of trouble

Hi, Restons received the CCA on 25th June, I've not heard anything since, they said they were going to obtain the original credit agreement from the credit card company. How long do I have to wait and if they don't supply anything what should I do next, do I just continue to make my monthly payments? Thanks

don't worry, the longer it takes, the better because they can stuff their talk of CCJs and charging orders while they are looking for this.so

a little more about the debt

what is it, how old, ie when did you take the original out?

who is the DMP with? how long has the DMP been going?

                      what is the balance now?

am with S&V, DMPs are a complete waste of time

I have today received paperwork from Arrow Global (who passed the debt to Restons), they have sent a copy of the agreement, that has my name on it but not my signature? Their terms and conditions and the last statement that said I had gone into default. In answer to your questions it was a credit card, taken out in January 2009, I owe just under £5,000 and I have been making reduced payments since 2011, first to the credit card company, then Arrow Global and now Restons.
What should I do now? The letter is asking for my proposal on re-paying the debt, which I did previously and they refused my payment offer (£25 a month) and said they were taking me to court. Do I write to Restons and offer the payment again (I have been paying this every month and haven't missed any payments)
                        Thanks

Did the letter say they were definitely taking you to court or that they may take you to court?

The letter said 'they will issue proceedings and apply to secure the debt against your interest in your property by way of a charging order' Can they do this if the house is in joint names but the debt is only in my name? Any help would be much appreciated as I feel Restons will be contacting me very soon and I'm not sure of my next step. I'm still making my monthly payments.
                                Thanks
