    IF they managed to get CCJ against you it would be a Restriction only

      As TC says, they can only get a charging order if the get a CCJ against you at court. Our legal team has a 100% success rate if you follow the advice given. If the debt is enforceable, arrangements can be negotiated to avoid a judgement.

        Thanks for all the advice, not sure what to do now, do I just carry on paying and not enter into any further correspondence with them? I have also received today a statement from Arrow called 'Remedy of Account' it also says that next steps: if I have an agreement in place to just continue with that, but Restons rejected my offer, do you recommend I write to them and make my offer of a monthly payment again (that they rejected?)

              So before we can say yes pay the £25 as normal or don't, I'm asking to see the CCA to help ascertain if it's enforceable or unenforceable. If a claim is issued it could help you (or not)...!

                        This is unenforceable. There are no PT's and it's a really bad attempt to satisfy s.78.

                                Hi, I've heard nothing from Restons since August 2016, your very helpful post in September said the debt was unenforceable. . I have carried on paying £20 a month to Reston. Got a letter today saying they are again going to apply for a Charging order unless I'd like to increase my payments. Are they just trying it on again? Should I just ignore them or write to them and tell them it's unenforceable. Thanks in advance for you help.
