I spoke to the court today they refused point blank and told me to deal with Marstons.

I spoke to the fines officer at the court who held the fine.

I will try again however.

I am just desperate I can borrow the money to pay the 410. Which is what the fine is but if I pay that online with the courts I'm reading conflicting advice what happens with regards to the baliff charges.

If you are in receipt of benefits you can ask the fines officer for a deduction from the benefit order. Single parent families are classed as vulnerable.

If you pay the magistrates court direct they will probably forward the money o the enforcement agency (Marstons) and bailiff fees will probably be pro rata'd from it -first 75 in full and then a 70/30 split.

After 90 days without gaining entry to your home the warrant should be returned to the magistrates court fro the bailiffs for committal proceedings and at that point you can ask the magistrates to alter weekly payment amount.

UPDATE:

Called the court they said they have no fines officer and told me I *have * to speak to Marston's they said there is no fines officer. They said I have to go through Marstons who decide if I'm vulnerable or not is this true?

So what do I do now?

Time is running out and another 110.00 is added everytime this guy shows up

I think that the court are playing games with you. Yesterday you posted that you spoke to the fines officer at the court and yet today there isn't one? Make sure that all doors and windows are locked and do not open the door to speak to anyone about the money. If they haven't taken an inventory of your stuff they can't take it, also the list earlier shows that a lot of your possessions will be excluded anyway. You are classed as vulnerable, so something can be done, I just don't have the knowledge to say what!

Please keep checking here because you will get more support when people get home from work etc. Please try not to get too worried, enjoy having your son around. If you haven't got the money they can't take it.

The advice about not letting them in and keeping doors and windows locked is sound, however, in principle at least, bailiffs can force entry when recovering magistrates court fines. In practice, this power is rarely used. Bailiffs enforcing other types of debt such as council tax or CCJs don't have that power. Fines are regarded as punishment for offences rather than debt, which is the reason behind the extra powers.

Update:

So thankfully I found someone from Bailiff Advice... and they took over they helped out so much and got intouch with the welfare department of Marstons. She spoke to them and got them to drop the 235.00 fee AMAZING... and they accepted a very low monthly figure which is affordable to me. They called me up after she did all the negotiating and I paid today and they will call monthly now to take my installment. I feel so much better the warrant has been recalled and they told me had I paid the court direct they would have taken the 75.00 fee off that first then pro rated their fee 70/30 I would have been in a hot mess.
