    January 2006 - made an arrangement to pay with them & paid the 1st one by dc, I thought the other was in my husband's name but they said it was mine so I rang back the day after to arrange payment & was told the amount they'd agreed was for both. I'd thought I'd to pay more due to the missing time since current account closing & new set up but originally they were £136 & £97 mth so the £250 they'd agreed was adding a bit on anyway. I then gave them my new bank details for the dd to be set up.

    February 2006 - I checked my bank acct & no payments were made to them so I rang & was told they'd never set a dd up as they couldn't do that over the phone! So why did you take my details?? I paid with dc what was owing. About a week after I checked my credit file & they'd placed a default marker on it! Don't remember being sent any notification.

    April 2006 - Checked credit files again (at the time i had an annual thing) & had the same 2 loans on it under a dca too - so it looked as if I had 4 defaults! Rang RBS & they said they would remove. I also asked for a redemption figure as we were in process of selling a house & would be able to pay them off.

    June 2006 - Paid amount they'd said to redeem. When I checked files a couple of weeks later everything was still on!! I wrote to them before going away for a week & when I got back a letter was waiting saying "my comments had been noted & they were in the process of arranging for my credit files to be amended to "satisfied" with the all cra's. Please accept our apologies for any distress you feel has been caused."

    August 2006 - Checked file & 3 had been removed & just one left saying satisfied -phew!

    That's it I had no idea at that time how defaults could harm & it was important as at the time we had 2 properties that we had as buy-to-lets & also had bought one to refurb & sell (which we had) & we'd intended setting up a property refurb business. However, when we tried to buy another we found it difficult cos of the defaults. Prior to that we'd been squeky clean. Anyway the rest as they say is history.....

    In March 2007 I went into meltdown, docs don't call it a breakdown now but that's what it was I can see it now but at the time I couldn't just kept crying, not sleeping & scared all the time. I tried to hide how bad things were getting (finance was always dealt by me OH didn't have a clue) stopped opening mail etc then slowly I started to feel a bit better & last yr decided I needed to address some of my fears (i.e; debts) so contacted CCCS who in turn advised me to get a copy of my credit files & hey presto this CCJ!

    Current timeline:-
    August 2010 - OH writes to RBS detailing just found out about ccj, letter from them re wrong accts removed from files etc, asking for them to let him know how could they have got a ccj as the credit files of Aug 2006 (luckily I used to be organised & kept things) clearly showed only 1 account with RBS & it was satisfied.

    September 2010 - Still no response & follow up letter sent. Then he rang & was told to ring Regal, he said no he wanted to speak to them (RBS) they said they'd put him through to the right dept & put him through - to Triton! he said he wouldn't speak to them but they said they had his letter but he needed to speak to Regal, he said he wouldn't so they put him on hold while they did & came back & said they were sending proof that there was a debt.

    October 2010 - Received a letter from RBS saying they write concerning a request for a copy of the loan agreement (never asked for one!) but our branch have advised they are unable to locate it! (some good news) They enclosed a screen shot to show that the amount was credited to the account (never in question- muppets)

    That's where we're at so I think I have a good case for set-aside & as they've admitted there's no agreement don't think they'll pursue it again. It's important now as I want to start a SW franchise & passed the interview only to be rejected on the credit check. I rang them a couple of weeks agao & it was because of the ccj (bit of a bummer really - ccj was added in Aug 09 I applied for franchise Sept 09 ) I didn't know at the time I thought it must've been for defaults, I only found out about the ccj after I contacted CCCS last yr & they said to get credit files! if I could get this off i think I should be ok as all defaults will be more than 3 yrs this yr & everything current is up to date.

    I'm a bit scared though, but that's why I've been watching all the court scenario's - trying to get empowered!

    What a nightmare you've been through FAW, I've got loads of adverse info on Hillesdens. Have you ever received a call or mesg from a company called sprint? they're part of hillesdens/dlc (and their chicken farm next door).They leave a strange mesg on my answering machine to contact them urgently regarding a manufactors problem with my car. Dirty B's they'll try anything to get your attention. Give me a shout if you need any help.
