Re: myself v MBNA advice please

recieved these two letters today the first one is on the account i sent the cca request for on the 25th jan which i have not recieved anything on as yet thats well over the 12+2 days .

what shall i do regarding the first letter ,i have already recieved a letter from the dca telling me that mbna no longer own the account ,so i sent them a letter[account sold while in dispute] saying that i was waiting for a reply from mbna on the cca ,and so far they have not tried to contact me .

the second one is on my other mbna account i will send a cca request for this one .

Its difficult to read but I think these are just the processes that happen when you default, the first one looks like some sort of Notice of Assignment, ie they've closed your account and sold it. The second looks like a termination, ie they've closed your account. I would wait and see who contacts you next about both then send the account sold in dispute, if you haven't sent off the CCAs, get them off first though.

Haha - they're selling it to the high and mighty Hillesdon

Seriously, await the CCA Request response and stop worrying, they cannot touch you as they sold these AFTER you sent the CCA Request thus s.78 protects you from any enforcement right now.

Just sit tight and ignore them but please keep us updated.

p.s. don't worry ok? It's fine, you're actually in control right now.

                  david

I know that they have entered a default on your credit file, but have they ever sent you a Default Notice?

When I asked for a copy or proof of the Default and Termination Notices, I got a reply in the post saying "MBNA did not issue or were required to issue a notice of default and/or termination and therefore do not hold a copy of any such notice on our system." Note that in this instance by saying 'a notice of default' they did mean a Default Notice because it was before they were obliged to inform you they had added default charges to your account.

Thanks for that, it may explain why I cannot find a default or tremination notice for my MBNA account. Just been looking through old stuff and thought I had been lax in my filing!

send this back to DLC ---> Our Templates | Unenforceability Templates | CCA Reminder - Unenforceability Threat

It's up to them to go back to the Original Creditor and ask about your claim.....
