          Have there been any cases recently (or not so recently) where Lowells have jumped from asking for the pennies to an SD without all the bits like Reds/Hamptons/Carter in between?

            They have been hammered in the past, so seems to have gone quiet on SD front, cost them monies, always on the look out for any updates on any situation with Lowells etc

              When Gold isn't enough, there is SA Gold! New to the forum and find the UE route a bit scary? Take a look at my diary here and judge for yourself. I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

                  Letter bombardment by Lowells as has been reported as to what to expect on another forum - forget where;-

                  Lowells = 1 x letter on letterhead from original creditor.
                  about 5 or 6 on Lowells letterhead claiming to know what you wear and when.
                  3 on Red DCA paper = Lowell in Drag.
                  3 from Hampton!s legal = Lowell wearing False Teeth.
                  1 from Lowell (swan song) : sometimes this step is omitted.

                  2014 - Letter from Red = A Discount off your Balance, pay us 70% of Balance or pay £2.00 per day equivalent to £60 per month, If we do not hear from you in the next 10 days, we will instruct Hamptons Legal.

                  /2014 - Letter from Red to-day = We are giving your account details to Hampton Legal ( Next Drawer no doubt), our pre-legal collections department.

                  Note they state:- quote:- Our recommendation could be to apply for a CCJ & if this remains unpaid then:-

                  Apply for the value of the debt to be secured on your property, or Apply to recover money you owe by making deductions directly from your earnings. or Instruct Bailiffs to remove goods from your home to the value of your debt.

                  An alternative to the above a Field Agent could visit you to discuss payment face to face.,

                  You can avoid the actions etc etc etc.,

                  Agree payment plan etc etc etc.,

                    Capital One/Lowells (credit card)

                    Received a letter from Lowells, which again had a copy of my signed application form and statements. Main points of the letter as follows:

                    They have complied with all my requests and cannot see any reason why the account remains unpaid. They insist that the account is enforceable and that they bought it in good faith from Capital One. Finally they would like to resolve this matter swiftly and amicably and have closed the account and will not take any further action to recover the debt. This is done with no admission or liability or wrongdoing. We hope that this concludes the matter to your satisfaction.

                    Sounds like a result to me
                    Fight the good fight and we will prevail
                    Proud to be a member of the AAD community

                        Permira acquires Lowell Group - (Credit To-day)





                        Permira, the international private equity firm, has announced today that a company backed by the Permira funds has acquired Lowell Group.
                        The debt buyer has been acquired from majority shareholder TDR Capital but terms of the transaction were not disclosed.
                        The Permira funds will merge Lowell Group with existing portfolio company GFKL, a provider of receivables management services in Germany, to create a pan-European credit management business.
                        Ontario Teachers’ Pension Plan (Teachers’) and the management of Lowell Group will remain shareholders. The transaction, which is expected to close in the fourth quarter of 2015, is subject to regulatory approvals and closing conditions.

                          20/05/2015 - Letter from Lowells to me 50% discount offered pay within 15 days bla bla bla

                          13/08/2015 - Last partial payment to Cap one was 11/08/2009 thu Bank, credited to Cap one account 13/08/2009. = 6 years!

                            For regulated debts, the six years starts from the point the creditor is entitled to take legal action for the whole balance according to the terms of the agreement, not the date the default notice was issued or expired as some creditors will claim. This is because the creditor could unfairly prolong the limitation period by delaying sending the default notice, for example if it took the creditor over a year to send the default notice then that would give them another year to collect the debt. That kind of action would be unfair to you.

                            To accurately work out the start of the limitation period, we would suggest you check the terms of the agreement and the date of your last payment. The agreement should indicate how many payments you have to miss or how far behind you can get with the payments before they would be entitled to take legal action against you to collect the debt.

                            So the six year limitation period starts from whichever of these is the most recent:

                            · The date of default worked out according to the agreement (not the date of the default notice)
                            · The date of the last payment
                            · The date of the last written acknowledgement

                            Based on the information we have, it is difficult to say exactly when the six year period started.

                            If the creditor believes that the limitation period is coming to end then they can consider taking legal action against you, as if they obtained a valid county court judgment then it would stop the debt from ever being statute barred. If you believe the debt is statute barred then the court would give you an opportunity to file a defence to the action.

                            If legal action is taken against you then you might want to consider getting legal advice before filing your defence with the court. You can get impartial legal advice from either your local Citizens Advice Bureau or Civil Legal Advice. They might also be able to comment on the potential fees and costs involved.
