I wish they would admit on paper that they don't have my agreement instead of pussy footing around, I think is it because they know I'm ill they'll wear my down and I'll pay up. Every couple of months they send me forms to sign my accounts over to my son, they say that it's their way of trying to help me. Ha Ha Ha heard it all now, NO CHANCE.
Like you say I'll just keep plodding along

LTSB recon was only up to date T&C's Niddy said unenforceable and send letter missing agreement,
replied with same papers again saying this was a recon as they don't have original because it's to old (20+years)
sent final response letter, they ignored it and past it to MOORCROFT I sent a sold in dispute letter and they replied with copies of the same saying it was valid and no need to give me anything else and to pay up
I'm not sure of what to do now. Thanks Elsa

Hi OAB,
hubby had this with his TSb cc they kept saying he would of signed and would send a copy when they found it, they passed it about quite a lot just kept sending SWID, missing PT, they insisted that the 'recon' they had sent was suffice to cover the CCA request, problem was they had put the address we live at now as the address on the CCA recon, we lived in Manchester when the account was opened,
they finaly admitted that they couldn't supply any info about the account last year, sent £60 for inconvenience caused and not heard off anyone else since , so keep plodding along with the paper trail xx

Hi everyone,
after sending MOORCROFT a sold in dispute letter had reply back saying they have been in contact with LLOYDS TSB.
who say that a copy of agreement is unavailable due to the age of the account and they supplied me with a reconstituted
agreement . but this was only up to date T&Cs , sent letter to TSB but only sent T&Cs again then passed to MOORCROFT I've got till 20/6 to clear account
Any suggestions on best course of action now. Thanks

we tend to send that template weather the account is just being managed by the DCA or sold on to a DCA, it is worded so that it covers most things

I'am not thinking straight at the moment, not having read the temple letter the SOLD bit confused me but will follow your advice and join AAD+ and get this letter off to MOORCROFT and see what they come back with. Thanks

Morning all,
Sorry to be such a pain but I'am all mixed up again, can I ask is there 2 types of letters to send to DCA,
Account in dispute and Sold while in dispute.
Briefly
CCA'd TSB they sent up to date T&C's
Sent query only T&C's. No agreement
Replied with Enclosed recon of agreement , we have complied with S78 and don't have to supply copies of original signed doc. But it was only the T&C's they had sent before.
TSB have passed account to MOORCROFT for collection and they want payment in full by Tuesday 5/5/15 and said that a default will be put on my credit file.
This account defaulted in 1995 and I have been paying them since then but stopped last year.
Any advice of what to do now please.

Thanks Pixie, it's the default that's got me worried, the account was defaulted in about 1995 and passed to SMC for collection.

Hi Oldandblue. You've already said what you're going to do, send SWID, which imo is the right response. You can find the SWID template in this section of the forum but you'll need to join AAD+ first to access it, see here.
Don't worry about the phrase "take further recovery action". It usually just means send more letters. Moorcroft dealt with my TSB account (and my Barclaycard) a few years ago and were easily dealt with.
Do you know if TSB had already registered a default because Moorcroft say their client (ie TSB) has registered a default?
