    It may not have been a proper LBA but we need to check because those letters are time-sensitive when they come from Keynes.

      Hi Plan B

      Threat is rom Keynes with 14 days to respond with full payment or arrange a payment plan. Threat details Practice Directives.
      MKDP admit quite categorically they DO NOT have a copy of the original signed agreement and indicate BC do not have a copy either.
      I was under the belief that to pursue this thru the courts a true copy of the original agreement was essential.

        What's the date on Keynes LBA? You really must respond within that 14 day deadline. I'll get a link posted to our Template Letter.

        The creditor can pursue it through the courts (i.e. issue proceedings) even if they've got nothing in the way of a CCA; whether they'll succeed in getting a judgement is another matter. What you don't want is for these proceedings to start. You have a choice to either tell it to Keynes or tell it to a judge. I know which I'd prefer.

                Please confirm the date on the Keynes' LBA to you so we can assess when the 14 days deadline expires.That's the most urgent question.

                      I have a letter from MKDP, same company, admitting that my account is unenforceable, but they may take actions short of enforcement as the debt is still due and payable.
                      Call to my mobile this morning, not answered as I was out of signal, call to home this afternoon, wife answered, not in, who is calling, MKRR. Looks like they don't intend to give up.
                      Roberts v Royal Bank of Scotland springs to mind if I get to talk to them!
                      They can try and frighten you, they can even threaten court, but cannot actually win.
                      They are trying it on.
