    I sent MKDP a copy of the e mails from FOS showing that Barclaycard had not complied with a S78 request. They could not provide a legible, or reconstituted copy of my agreement, nor could they provide the "prescribed terms". End of story, or so I thought!

    Letter received today.
    Dear Enforcer,
    Further to your recent correspondence regarding the above account. I can confirm that a Final Response was issued to you on the 27th September 2013. As no new information has been provided to us regarding this matter I must advise you that our complaints procedure has now been exhausted and we are unable to enter into any further correspondence regarding this matter.

    As confirmed by Barclaycard all points referred to in the Financial Ombudsman conclusion have been adhered to and your section 78 request was complied with in May 2013 and your account remains enforceable. I refer to their letter dated 1st October 2013 where they have advised you that their position remains unchanged and they have nothing further to add.

    Blah Blah go to Fos, etc.

        I think you need to reply to her letter. MKDP are trigger happy when it comes to issuing county court summons. It's better to tell her where she has gone wrong than tell it to an unsympathetic judge with his fingers in his ears further down the line. You need to lay a paper trail.

          Already done that. I sent her copies of e mails from FOS showing that "senior people from Barclaycard were trying to find an agreement, then that they could not provide a more legible copy, nor the prescribed terms. What more can I do to help her?

            Just send a letter back, refering her to your letter where you state the copy is illegable, and say something like, like you, until such time as my request is properly complied with, i have nothing further to say to you.

            Something along those lines, may need tidying up abit.

                    After receiving a mock up recon agreement from these numties, which has various discrepancies to one sent by the OC, I sent them another letter stating there were differences (but not what) and a CPUTR request to confirm or otherwise that they have a copy of the original agreement, signed and fully compliant with all prescribed terms. So far this has been totally ignored, except to issue a letter of further action which I received today. (really shacking in my shoes now). As they are now in default of my CPUTR request any advice available on what action to take next would be very much appreciated. Thanks in anticipation.

                          Recently received this from MKDP.

                          Dear Mr.-----------

                          Further to your recent correspondence and to our letter of acknowledgement in regards to the outstanding balance on my account. Please accept this letter as a final response to your concerns.

                          I understand you have requested that we state clearly whether we hold an original signed consumer credit agreement or not

                          I can confirm that whilst we do not hold an original signed consumer credit agreement we have spoken to an employee of Barclaycard who has confirmed that in accordance with the information stored on their systems and in line with their procedures, a properly executed agreement was in place in accordance with Section 61 (1) of the Consumer Credit Act 1972. (Yes 1972).

                          There is no requirement to provide you with an original signed copy of the executed agreement. Our obligation is satisfied by providing you with a reconstituted which is legible. As you are aware we have provided you with a copy.

                          We believe the copy of the agreement provided to you by Barclaycard is fully compliant with the creditors duty under section 77/78/79 and contains all the prescribed terms.

                          Due to the information stated above, I regret to advise that I am unable to uphold your complaint.

                          n.We therefor request you contact us on xxxxxx and so on.

                          Any further comments and advice would be much appreciated.

                                Recently received a threat of litigation letter from MKDP's collection agency despite the fact that MKDP have admitted they do not have and cannot produce a true copy of any agreement relating to this alleged debt. Should I reply or just ignore, rather than enter into more letter tennis.
