    Totally agree...it's just a get out clause, bespoke probably meaning simply a colour/fabric choice from a range as opposed to having a specially made unique item. Buggers aren't they?

          Loads of people have made the same mistake, mrcc, you're not an idiot and you're not alone.
          Just ring and cancel as Niddy says, ASAP, follow it up straight away with a letter of cancellation by recorded delivery and follow the contractual procedure for cancelling the finance..again make sure you back it up in writing.

            Hi,

            Just got back and phoned Barclays finance to see what I can do, and it looks like I only have the option to "Withdraw" and not cancel the finance agreement. The nice lady on the other end told me that only the retailer can cancel the agreement.

            Looks like I should be optimistic now about the what actually gets delivered.

              Ahh shit, of course if you signed the agreement on their premises then you don't get the same level of cooling off (5/14 days). I totally overlooked that, you don't get a right to cancel (credit) if you signed it there and then in store...

                when i took out my comet card (santander) i had 14day returns and cancellations in he agreement.

                      Hi,

                      I am Flossy who Niddy mentioned going through a nightmare with SCS and about having taken out credit with Creation for a SCS sofa 2 years ago which I am still fighting this case to date! Right now I am at the litigation stage by Creation as I haven't paid for the sofa due to a list of things but mainly my first sofa being the wrong way around (corner sofa) and the SCS delivery men from SCS scrapped all my sofa, broke my light and expected me to clean it up and be happy about it all... I was at the time in a wheelchair as I have been ill for many years with my back. The sofa then collapsed and the upholster eventually came round after months of calls, emails, letters to put yellow pages under it to hold it up to stop further scrapping on my wooden flooring!

                      The next sofa (that I didn't ask for or want) was delivered and I didn't even know what it looked like and didn't fit in my lounge. It was a different shape than my original sofa and colour, size, round and not L shape, height, width, etc..... The Manager came to my house and a sales guy as they knew I was unwell and was not fully aware of what I was doing due to being on very high doses of Morphine and other very strong medications. If Id of known what I do now I would never have accepted the sofa as their agreements stated I did not have to and if Id of refused it I would not be in the mess I am now! Basically SCS will take advantage of you if you let them, especially if you are ill, elderly, female alone, or any other situation they feel they can talk you into. They are very good at saying one thing and doing another.... Personally, I would not accept a sofa from them but, you may have a different opinion about your new sofa!

                      Can I ask you a few questions?

                      1) Did you take out finance with Barclays or Creation?
                      2) Did you buy what they call 'stock' or was it 'made to order'? (When I say that I mean made to collapse) lol
                      3) when did you order this sofa , sofa's, chair?
                      4) When is it due to be delivered?
                      5) Have you spoken to SCS to try and cancel the sofa? If yes, what have they said?
                      6)They have their own T & C's that are online and not on your contract that they give you. If the sofa is stock then it is dealt with in a completely different way than when they say it has been especially made for you. I can give you the details of this as I have now gone through it all with them on the phone, emails, who to need to talk to and how they work and try and fob you off.

                      At the moment if you haven't had the sofa delivered you are in a very strong position. I can help you to cancel the finance after dealing with them and all their bullshit get out clauses they use. I am in a different position than you and if I had to do again I would know exactly what to say and do with SCS and the finance company.I also wouldn't ever order from them again ;-)

                      Can you give me a quick run down of everything from when you walked into SCS to date please? Sorry if I am asking any questions that you have already been asked but it would be good for me to see everything on one page so I can advise better.

                        No. If you haven't got the sofa and you have just ordered it then you cant pay for something that you haven't got! If the sofa is 'stock' then that's even better as you can cancel all agreements under their own T&C's (SCS). If they insist that you have to have the sofa, you do not and you can refuse delivery.

                          DO NOT GIVE UP.....

                          You are not an idiot for using SCS. I did the same as you and as many of others have done and used a big firm that you would expect to receive good quality items from. Unfortunately, SCS are not as described above! They will look for every way possible to stop you from cancelling this agreement as they will have already been paid from Barclays for the sofa and bare in mind these sales guys including the manager (who sold me mine) are also there for the extra money as they only get paid a basic wage and rely on people like us to buy from them to get the commission. As soon as you have walked out of there they will have had the finance agreement set up, been paid while they sit there rubbing their hands together!

                          They have not had a sofa MADE for you in the time scale you have said. It would take longer than that to be 'made' from scratch. As the agreement was only done a few days ago and as Niddy has said that ringing the manager up asap needs to be done. The manager will avoid you at all costs and give you a bullshit story of how you cant cancel the order. As I have said earlier you are in a good position as you have not got the goods yet. (sorry I asked loads of questions before reading your diary properly but I just wanted you to clarify everything so I knew exactly where you are up to with it all)... You do not accept the goods when they say they will deliver.

                          I will get the link for you for SCS own T&C's that they do not put on your contract but do apply! They have them on their website in a hope that you will only look at the piece of paper they have given you!

                          The link below is a brilliant link of the OFT guidelines. I was given this link on my diary about SCS from a member called Salt n vinegar. It is very useful and tells you exactly what is fair for the customer and the consumer.

                          I will keep my eye on this thread and hope you haven't given up and you intend to just accept the goods... DONT. You can get out of this and believe me if you dont do it before you get the sofa then it will be a nightmare trying to get them to get it back out of your house... I know as I am still trying to get them to take mine back 2 years on!

                              I really dont want mrcc to make the same mistakes as I did. If he/she doesn't give up and I can help them to not be another victim of SCS like I still am 2 years on then great. I am just glad that I can contribute to something on here...

                              I am sorry I waffled for ages though (I think thats what you meant by mrcc will have enough information!!! ) as I am the world best waffler! (made that word up all by myself) lol I just had a million things in my head to ask.. I do know now after my experience what to NOT do and what TO DO where SCS are concerned. I am quite passionate about SCS if you hadn't noticed!
