    They took action against us 6 months before SB but to be fair we thought we'd paid 6 years earlier. They tried & they lost. That's all I can say but the fact is they're dirty cheating lying conniving bastards who all deserve to burn at the stake.

    Yes they will issue a claim - as I say they are bastards who deserve to burn at the stake.

    Hi Beefy, I received exactly the same letter from Marlin yesterday, it's even dated the same (frustrating when they give you 7 days to respond but with no working days left in between receiving the letter and being able to get a response to them

    Hi PlanB,

    This is a post 2007 debt and they sent me terms and conditions and a screen shot of the application I made online so they did comply.

    I still have that information in my file.

    I've gone back to your post in October 2012 above.

    Do you have the letter from Cabot which says they can't comply with your CCA request made in 2009 (or was it later than that?)

    It won't make any difference to Deepie's wise suggestion to send another CCA request asap but we do need to know the full facts before we can predict the next step after that.

    Yes, because the debt is not yet statute barred. As long as they issue proceedings before February 2015 they believe they're in with a chance. Let's be honest that's almost a year away so you need to keep them talking or they will press the MCOL button..

    I haven't read all through you thread so I will hopefully come up with something more positive to say when I have. In the meantime do as Deepie says and send off that s.78 CCA request immediately.

    Firstly thank you for your replies.

    SB date is February next year and this is my only debt now.

    Normal letters are fairly generic but this one seemed different. I just need to keep them away until it's SB - After all this time would they really try and get a CCJ?

    I would do as deepie advises . but I did think the letter rather strange, they (Marlin) are intending to instruct a solicitor, but then they say they are going to advise Cabot to take it further ?
