Letter of Claim received HC / RW - ex Lloyds - HF UK Holdings 3 Ltd.

  • Letter of Claim received HC / RW - ex Lloyds - HF UK Holdings 3 Ltd.

    Good morning,

    Again I'm asking for some guidance on this as the claim letter has been received.

    Briefly - Lloyds CC £2400
    Stopped DMP May 17
    Passed through 3 other DCA
    Assignment to Hoist Nov 19
    RW handling since Dec 19 Two discount offers received.
    Return form required by 25/12/20.

    I have made no contact - SB is not until June 23

    My assumption now is to return the claim form around the 14th

    Box D then Box I

    With Box (I) I am thinking to just send an attached CCA request. Leaves me just a couple of questions:-

    Is there anything I should send extra to HC?
    Should I SAR Lloyds now?
    Do I fill in the Income / Expenses form, is this a requirement or just fishing?

    Thanks in advance for any help.

      When (what year) did you open this Lloyds credit account?

      Don't send a CCA Request or complete the Reply Form from the Letter of Claim until more facts have been established. Sometimes it's better not to tick Box D or reply at all.

      Definitely don't ask Howard Cohen for documents which will only give them the opportunity to source them or reconstitute them, and then they can issue a claim with all their ducks in a row.

      Email me the first couple of pages of the Letter of Claim so I can see what they intend to claim and why they think they have the right to claim it using di@joannaconnollysolicitors.co.uk

      Send a SAR to Lloyds asking for all data.

          I’ve received your email.

          Maybe we need to talk about the date which you believe the credit card account was opened in case it differs from any date referred to in any Letter of Claim (hypothetically speaking)

              It's all sorted - your email was forwarded to me

              There is no legal obligation to reply to a Letter of Claim.

              However, Lloyds have an obligation to reply to your SAR so send that now to see if it sheds any light on the dates, or whether they still have any documents in their files, especially anything about a Default Notice.

              Definitely don't ask Hoist (Howard Cohen) for anything until the picture becomes clearer. (or at all). Time for discrete research behind the scenes!
