    I took advice from National Debt Line who passed me onto CASHflow who help you to self manage your DMP but with a ref number and Templates letters with their logo on its worked well for most of my creditors except Monument and Capital One who are unbelievably bad

      Hi guys

      i had this problem when we were on our DMP wit Amex, defaulted me, terminated me and passed me to RMA and still kept piling on interest. I phoned FOS and they took a complaint on the phne, the chap there said Amex were compounding my hardship for gain. Sure enough i got a letter about 6 weeks later from Amex saying yes they agreed, refunded all the dosh they had charged and gave me an extra £50 for my worries. So if you're not going down the UE route, its worth a complain, incidently the treatment by Amex was a contributory factor in going for UE and theirs is very very unenforceable!!!!!

        I did complain to the FOS about Capital one had a final response then defaulted and passed to DCA I think I will now follow that one up maybe by Telephone (goes against the Grain but saves a few trees)

            had one years ago and paid it off.........

            don't phone the DCa or Cap 1 but do phone FOS, there is quite a tight schedule they have to keep to with complaints, there are time limits, so if they haven't come back to you, I would phone FOS again.

              Hiya

              When your account is sold it shouldn't generate interest cos the account would be terminated, so basically after you've been defauted there will be a value of default registered with the CRA's - that is the total you owe, so they can add £10k of charges, doesn't mean the charges are lawful.....

              Point is, it is best to get defaulted in some cases. What you're talking about suggests it's one of these where they buy the debt and then give you 0% for so long to repay iot, can be beneficial but it does mean signing a new agreement - it depends what the balance is and whether you're going down UE or not really... but don't be hasty in signing anything.

                You're quite right, they should stop charging it after they have defaulted you or terminated the account. When the debt is sold from dca to dca then charges may accrue but you can always haggle them back down anyway. k

                Also, your creditors should be defaulting you after 6mth of adverse activity.....

                    Template for dealing with Debt Collection Agency

                    Hi all once again
                    Are their any links to template letters for dealing with DCA its credit solutions ref my Capital One Debt sent off SOA and offer letter only recieved back a card stating someone will call on (no date filled in ) at (no time filled in )so just want to make sure my bases are covered looks like more trees going im afraid

                          Hi
                          Got the FOS looking into my capital one complaint and there refusal to play ball with my DMP they told me to ask capital one to put a hold on my account while they investigate I was passed to Credit solutions by capital one aswell so I sent them a letter asking to hold my account but im worried if its not paid this month what will happen and who would i pay anyway credit solutions have harrassed me a bit over the last couple of weeks so sent them the doorstep letter and heard nothing since any views on what course of action or should i wait for FOS reply

                            Just wait for FOS response.... they can't do much cos the account (or an element of it) is in dispute. Just chill, see what happens yea? Or ring the FOS caseworker for an update, of course?

                                Hi I have had a letter from credit solutions ref my complaint to the FOS they have asked for a copy of the letter I sent by the 31st October so they can put my account on hold as requested and they say they have every right to doorstep call even though I sent a Template letter asking them not to so what happens next but strangely I have not heard anything from Capital One .
