    Are you telling us everything....?

Ergo, I asked if you recall anything as it was only a couple of years ago - a lender would not default you for that amount and not write once, so all I can think is you must have moved?
Or someone at Lloyds The Stupid Bank may have accidentally removed their head from up their jacksi?

Hmmm, good idea but really, can you see them being able to operate properly with their head in the normal upright position?

Nah, I can't see that happening.....

Re: Default found on a account closed

        Hi people, I thought I would do a update as I recieved a letter from Llloyds today. The letter states the following;

Thank you for contacting us to ask for your persosonal information that we hold in our automated systems and paper files.

I will be pleased to provide your information and will start to collect this straight away. Thank you for your postal order for £10, which we recieved on 7th september 2011. the act allows us forty days from the receipt of the fee to respond to data requests. we will have your personal information ready by 17th october 2011.

As you no longer hold an open account you will need to collect your data from a Lloyds TSB branch of your choice. You will be required to show some sort of identification, such as a passport or driving licence, when you go to collect it.

Please indicate on the attached form which branch of Lloyds Tab is most convenient for you. We will write to let you know when your parcel is ready for you to collect.

if we do not receive a response from you within one month we will close our file. We will of course re-open it should you come back at any point afterwards.

        Yours sincerely

        Some knob

then the next part of the letter asks me for

        Sort code
        Address
        Name
        date

its not asking for me to sign it. So I guess this what I have to do.

Further update when I receive the PARCEL!!!!

Re: Default found on a account closed

Sorry - totally forgot about this - send this to Lloyds
                  Dear Sirs,

                  Account No: XXXXXXXX

I recently requested that you supply me a copy of all information that you hold about me, this has not as yet been responded to, in accordance with the provisions set within s.7 Data Protection Act 1998.

I clearly explained in my original letter what I expected from you, there is no provision for me to retain an active account in order for you to comply with the Act. If you can please quote me the relevant guidance that confirms you're allowed to refuse to deal with my request, knowing full well you've previously communicated with me regards these accounts, so either way you're in breach of the Act - please be so kind as to confirm which element you're admitting to, prior to my making a formal complaint to the ICO.

Obviously, if you're now unsure of my person then I have to ask, why have you been sending statements and other sensitive data for many years? I suggest you comply with current guidance and post the SAR to me, I will not go into branch as this is not necessary; I have no need to attend a branch - I am happy for you to post it to the registered address you hold for the account holder.

Your responsibilities remain intact throughout this disputed period and the 40 days continue to count down, at the end of which, I shall be formally complaining to the ICO regards your absolutely dire attempt to delay things and/or get me to go out my way to attend a branch unnecessarily.

I do, expect the main actions to be dealt with, as matter of course, and look forward to hearing from you in due course.

                  Yours faithfully

Within this letter I have noticed that some things that wont apply to me.
                        1) the registered address that they should hold for me I do not stay in nor does anyone I currently know. I did however request the SAR from my current address where they replied back to.
                        2) no statements have been received from them since 2005 approx as I no longer lived at the address they hold for me.

so my question is can I still use this letter as I dont wont them to send all the information they hold agaisnt me to my OLD old address where it wont be possible to collect it from??

SOrry for being a pain Niddy...

As a result of the hidden/secret address then you will have to, in that case agree to collect with ID. Apologies, as you have not changed addresses then it is not applicable - however you're not in debt with this are you? so it doesn't matter I guess.....

I dont believe that im in debt with this. This was sprung on me as I checked my CR and found they defaulted me on account that I thought was closed. Anyways, I will send it off and report back when I get it.

                            Thanks
