              Just makes them work (think) for a change.
              Tempted to see how far this goes as if it goes to court then i'll be counter sueing them (for libel) as they never technically defaulted me and casting any potential claims outta the window.

                  Debt Managers are at it again.

                  Will post copy when scanned it.

                  Also gonna have to send them a nice reminder that i am in dispute with lloyds still and that until that is rectified i shall be ignoring all communication from them.

                    Not only are they mistaken about the matter of bank charges - the verdict that they were "not penalties" came from the High Court rather that the Supreme Court - there seems to be a curious glimpse of their arithmetical prowess.

                    According to their Andrew Cunningham, £630.97 is 25% of £1708.88 rather than 36.9%.

                    If he is the same Andrew Cunningham who attended Aberdeen "University" in the late 1970s, I now know why he was a student in the Arts Faculty.

                      recieved yet another letter off Andrew Cunningham basically telling me to Fek off. although he wont be happy when he reads my most recent letter that i'm sending in the morning.

                      Might hit home about the whole farce that their Collections Department and Consumer Debt Recovery departments have actually (in their eyes) "got away with".

                      After all this i will need a beer

                          Well i'm sending 2 letters

                          mainly because i hadnt sorted sending the 1st 1 as been busy moving and didnt have the time to.
                          for example i moved house after working the overnight shift got home had an hours sleep then went picked up a van and started moving stuff from 1 house to another.

                              Finally sent off 2 letters to him

                              Main letter
                              Please read the enclosed letter as this was meant to be sent to yourself mid June but due to moving house it had been delayed.

                              In response to your latest form of communication I must say that you shouldn’t have wasted the paper its written on. The reasons why I state below
                              • You are going in circles. Almost like you like travelling round roundabouts and seem that this is all you are willing to do which is not only wasting my time and therefore my money but also wasting your time. Efficiency isn’t something that is suggested in your offices is it?
                              • I have already had a DSAR and the information that you say should be in there isn’t and also I have been unable to request a further DSAR as its “not within a reasonable time since last request”. This is in itself a load of tosh and if I so wish to request a DSAR every week then I have the right to. Especially under the current circumstances and the considerable amount of Changes in respect to the account and its subsequent closure.
                              • Under my internet banking, that is now totally disabled due to the account being closed down by yourselves, there was no ability to see an Online Statement. Although there was just a list of transactions from account opening till the last point I had access. I can confirm this with my partners account so please don’t lie to me and treat me like a moron which is all I am getting from yourself. If you have the ability to counter this with some confirmation Preferable with screenshots then please be my guest but do not try and take me for a mug as I will not stand for it
                              • I had disabled paper statements some time prior to May 2008 so I didn’t have any ability to know whether there were any charges to be placed on my account and the totals of these charges. This is backed up by the countless times that I had to ring Collections to find out whether there were any charges to be placed on my account and the totals of these charges. This was due to me not wanting to have to file everything but since then I have found that it makes more sense especially seeing as I am having to deal with matters like this.
                              • In regards to a Default Notice you have not followed the correct lawful procedure. Needless to say that you should contact the relevant department and ask for a step by step guide to how the breakdown of a relationship between creditor and debtor should then be taken and the need for a default notice to be sent to a customer and the need for this notice to have reached the customer before a default is placed on a credit reference agency file.
                              • In regards to a full and final settlement this is no longer an option in front of us and in all honesty hasn’t been since the offer I made August/September 2010.
                              • As I have repeatedly mentioned I WILL NOT COMMUNICATE WITH DEBT MANAGERS LTD! This is because as I am in a FORMAL DISPUTE with yourselves I only have to deal with yourselves. So I politely remind you to call off the dogs until this dispute is resolved and this is because of the fact that you are acting unlawfully by even passing on my details to them in regards to this account. FULL STOP!!!!
                              • Finally this last letter you sent me is not a “final” Reply. I take this as you basically saying that you further wish to cease all contact with myself and if that is the case then please feel free to follow the course of action that I have enclosed for your interests.


                              Also I must remind you to not to take me as a dimwitted fool that will roll over or jump when you see fit. As things stand the ball is in your court to finally sort this problem out once and for all. Needless to say I feel that no matter how ignorant all your departments have been in the past that you will see this as an opportunity to set all right between ourselves and to put all accounts back to the point before all this come of light and by that I do mean all the way back to May 2008 as the FOS would and will instruct you to do so.


                              Let this be the last time I have to contact yourself regarding this matter. Also please note the new Address as provided at the top of this letter.
                              Letter ment to send June time
                              I am rather disappointed by the lack of care in making sure that my last letter managed to get to you albeit only from your mail signing point to yourself.

                              I would like to point out that if it hadn’t been for the excessive amount of charges, which mainly seem to be charges on charges, placed on my account then I would have stayed a LloydsTSB customer.
                              However as your records will show you that in July 2008 was the last time I properly made use of the account as my main Current Account with the last payment from my employer at the time.
                              I would also like to point out that I made the right move in moving all income and outgoings to a different account (as was and would be advised by CAB) as I was on Jobseekers Allowance from 1st July 2008 until 7th October 2008. My Jobseekers Allowance Claim was then Suspended for 3 months as my previous employer lied to DWP saying I had quit work whereas I had actually been dismissed from my role.
                              A copy of the dates I was in receipt of Jobseekers Allowance is attached

                              It was at this point of October 2008 that I started looking and applying for work and was unfortunately not very successful due to the beginning of the recession.
                              I then at the end of November 2008 resubmitted my Jobseekers Claim and in the space of a week managed to get a 2 week temp Christmas Job. This ended at the end of the 2 weeks as there were no further contracts for full time work available.
                              I then Resubmitted yet another Jobseekers Allowance Claim in January 2009 and was on Jobseekers until early March 2009 where I managed to find my current employment.
                              I would like you to consider that in this period of June 2008 until March 2009 any and all charges that you applied to the account would be overseen as you placing me in a financially uncontrollable spiral of charges on charges and at this point I would be advised by CAB to open up another bank account elsewhere as to be able to pay for the essentials and necessities.
                              This Action of placing me in a financially uncontrollable spiral of charges on charges could have quite easily been over come in July 2008 when the first lots of charges were placed on the account and that would have been for them to be the last charges placed on that account.

                              In light of this I feel the refund (if you can call it that) of £815 to the account is rather pitiful and you trying to display yourselves as doing the right thing.
                              This however says to me that you have realized that you have failed the customer in this case and tried to make a small but insignificant gesture to basically shut me up.
                              I must say I do not like how that has come across to me and feel that you are trying to insult me.

                              I must now ask that you take a professional view on how this matter has been conducted since the beginning of this farce that has become to be known as how you treat your Customer’s fairly and do something that doesn’t insult my intelligence.

                              Need I remind you that if I were to pursue this to the FOS then that would cost you £500 as their mediation fee. So I feel that in all fairness to us both that we should try and settle this matter without the intervention of FOS and only when you send me a final response in which I am unhappy with will I consider taking further action like going to the FOS or OFT.

                              In the interest of fairness, I can only suggest that 1 course of action can remedy the situation that has become and this includes as follows
                              • Refunding all charges that have been added since July 2008 (and including the interest charged on the overdraft)
                              • Totalling the payments made to the account that brought the Overdraft down and working out if there is any remaining amount either to be paid or to be refunded to me
                              • Re-opening the account
                              • Removing the default off of my credit files as if it hadn’t been for the charges placed on the account in this period highlighted above then the account would be in fine running order.
                              • An offer of compensation for the time I have wasted in dealing with this matter for almost 3 years and the stress this has caused and the damage done to my credit files as a result of your constant contempt for the facts placed before you.



                              I must also remind you that Debt Managers LTD at this present time have no lawful claim or litigation towards collecting any debt I may owe LloydsTSB due to the fact that I am in the middle of a dispute with yourself. As I have stated to yourself and to them that until this dispute is resolved I no longer will communicate with them as is my legal right until this is resolved.

                              I look forward to hearing from you within the next 7 working days and please note the new address as provided above.
