      Red Alert...

      A letter from BC.

      I have 14 days to pay in full or they recommend litigation to the client.

      Freds would have had my letter for a few days by now, but no reply as yet!

      Guidance please oh wise ones......

                Ok,

                Didn't need to send that letter in the end, as the next day I received a letter from Fred's saying the account is now on hold pending instructions from C1.

                We'll see what happens next....

                  Hi Guys,

                  Update.
                  I got a reply from C1. I've not really seen anything like this yet. It's like they've actually read the letter and attempt to respond to each point.

                  Interestingly, the tone of the letter toward the end is that they think I might take THEM to court, and they are inviting me not to?

                  Anyway, they still mention that they have sent me a copy of the signed signature page of the agreement, which they have not!

                  The letter also states clearly that they do not hold copies of the original agreements, just a scan of the sig page.

                  I think I might scan this and let Nids have a look if he doesn't mind.

                  In the meantime, do I tell them that they haven't sent a copy of the sig page or not?

                    i have a couple of those Chippy, it's just what Cap1 seem to do, ours were then passed on to another couple of DCAs which have been duly told that the account has been sold in dispute and I have a letter confirming they can't find the agreement, which in essence is what yours is saying.

                    It just seems to choke Cap1 to actually come out and say, err we definitely don't have it and we won't pursue.

                    I think you'll be contacted by another DCA now, I would wait and see

                        I think they sent one scan of a wee signature on its own, and nothing for the other one, it's nearly two years ago so the memory dims.........................but Niddy pronounced both totally unenforceable. personally if they have sent you a letter stating they cannot find the agreement, then it's UE, that's an admission they haven't got it, so end of until such times as they find it (if ever) you just need to keep fending them off now until it goes SB

                          The actual wording is this..

                          "To confirm, we do not retain the original of the signed agreement that is returned to us, but scan the signature portion of the agreement and retain this within our account system. On the reverse of the signature portion of the agreement were the prescribed terms of your agreement"

                            yeah and then on the back of your agreement was a wee clause that let you spend 100million with no comeback and a payment term of three and half centuries at 20p per month........................

                            so basically they got squat....................

                                Update,

                                They eventually put Fred's back on the case.

                                Now, rightly or wrongly, I sent a cputr request to try and get them to actually admit (properly) that they don't have the agreement.

                                Their response was basically,

                                "we understand you are making a request under cputr to confirm whether we do or do not hold a signed credit agreement pertaining to yourself"

                                "After reviewing you account, we have already sent you the information you require"

                                "however, we have enclosed another copy of your signed credit agreement for your records"

                                Blah blah and it's still enforceable etc...

                                Thing is, all they sent was simply a copy of some typed out terms again!! - no signed agreement! Do they understand what a signed agreement is??

                                Anyway, I don't know where they're going to send it next, but when I get a further letter maybe you guys can advise on the next course of action............
