    Try not to worry Kitty, as they know its getting near SB they are ramping up the threats.

    The idea is that you worry enough you make a mistake and contact them and acknowledge the debt and consequently reset the SB clock.

    But you're not going to do that right?

      Definitely don't respond, yea the threat is a good one but right now the last thing you need is to be resetting the SB clock.

      Try and not worry, all DCA's ramp things up within the last few months before it becomes SB..... don't capitulate now...

        Well i must admit after reading Scabhunters reply on statutory demands i do feel slightly worried,but thats what ruthbridge want me to feel like right?I know its unenforceable and it'll be SB'd in 10 mths so its just a waiting game..

        No,i definately wont be contacting them thats for sure.I wont be making that mistake.I've made sure every reply has "i do not acknowledge this debt" on.

        Do i just ignore this letter then,or is there a reply i could send them,maybe a template letter or something?Or is ignoring them the best option?

              Sincere apologies – it was never my intention to worry anyone. It is just a lot less stressful to have a Statutory Demand land on the mat when you already have your set aside forms written in your head and know exactly what you are going to do, than if you haven't done any research and have to start from scratch.

              What I would do is prepare for the worst but hope for the best. I think Ruthbish are bluffing, and the fact that they are prepared to offer large “discounts” supports that. I would just want to be prepared for the attack should it happen.

              I also would not respond to them at this stage.

                why? If they attack we'll set Paul onto them..... he normally finds fault, especially on a 5.2yr SB debt.

                  No apology necessary,i welcome all the advice on this forum as i know everyone here is just trying to help.


                  Yeah,i think they're bluffing too because of the offer of the discount.When i had letters of Mercantile Data Bureau on behalf of DLC,they offered a reduced settlement of 1,700 which i ignored back in December 2011.


                  As has been said,i think they're just ramping up the threats 'cos of the SB'd.


                  Time will tell i suppose.Thanks again for the replies guys.

                    Would that not introduce an unnecessary element of risk?

                    If the case went to court, and the set aside granted but with costs not awarded (which does happen), the OP would then be liable to pay the solicitor's bill out of their own pocket. Defending as LIP at least prevents the possibility of that happening.

                    Or am I missing something?

                      Yes they do charge but if there is a good chance of success, they may consider other options etc..... read the legal claim against you thread!

                        Hi Niddy

                        I wanted so advice please as yesterday I received a letter from Lucas Credit Services (this old debt from this thread has now been passed on to them)it .Just to summarise,its an old debt which will be SB'D in August,has been passed to various DCA's over the past few years.I showed you the paperwork a while ago they sent me and seems like its unenforceable.

                        The letter I got yesterday says the same old thing,pay immediately,if not further recovery action "may" involve a debt collection agent visiting at home.

                        I just wondered do I send a no doorstep visit letter to them marking the letter "I do not acknowledge this debt" or do I just ignore or..

                        Cant wait till August!

                          I am in the same position as you, my old debts go SB'd in August and I am receiving constant threats!

                          If they threaten to visit, then I send the no doorstep letter.

                              If it is that close I would ignore it. Most of these threats are false anyway, and if some idiot does turn up what can they possibly do?

                              The only thing you need to worry about is an N1, not a doorstep polluter. If they are making this type of idiotic “frightener” threat, instead of a direct threat of litigation, then they are obviously not about to do the one thing which could potentially cause a problem.

                              I'd leave it alone, but it is up to you.
