    Hi again

    Received a letter from Hillesden today about this same account again regarding my doorstep visit response letter,saying if the account is passed to external agents for a doorstep visit,they will fully comply with the guidelines set out by OFT.They go on to say they have responded to all issues raised by me and now await repayment proposals by return.Is there any letter i should send back to them/any advice please.

      Nope ignore em! You have said not to call at your home so if they do they are breach - simples.

        Get a super-soaker water pistol and, if one of their goons should shew up, tell him to clear off or be drenched.

          Hi again

          Sorry to bring up an old post of mine but i recieved a letter from dlc this morning.Hadn't heard from them in a long time and was hoping they'd given up as the debt is statute barred next August.

          They say the same rubbish,reviewed the account,cant reach an agreement so have instructed external agents Ruthbridge to manage the account from now on.

          Any suggestions?Ignore until i hear from Ruthbridge?Then what happens,send them the same letters all over again that i sent to dlc i suppose...

          Cant wait till the 6 yrs are up!

            Hiya, well you don't have long to wait - it is normal for the creditor to become active in the last 12 months of an account as they too know it will be SB'd - just sit tight and keep us updated.

                Hi

                Recieved a letter from Ruthbridge this morning saying the debt is now passed to them and to pay up basically or they "may" recommend their client apply for a CCJ and if its not paid their client "could" apply to court for further action to be taken such as bailiff,apply for attatchment of earnings,and a charging order against my property.

                They say phone them to discuss repayment.

                Having dealt with DLC for the past 5 and a bit years i realise this "may" and "could" is just threatening and scare tactics and i need to hold out for the 6 yrs to pass.Still not nice to read tho..My question is do i reply to Ruthbridge and if so what do i say.

                    I know it doesn't really help much in dealing with the content of the letters but its useful to know that Ruthbridge are close to the bottom of the DCA food chain and 'specialise' in purchasing SB or near SB debt.

                    Fingers crossed you sit this out and then it'll be SB

                      Thanks for your help guys.Yeah cant wait till August of next year for the 6 years.Just gets unbelievably frustrating when you hear from a DCA after a long time of no contact.I didnt know whether it was the same process all over again with Ruthbridge as DLC and i'd have to send template letters as before,so its good to know just to sit tight and do nothing for now.

                      Fingers crossed they wont contact me much between now and then.Its great having a forum like this,really really helpful,cant thank you all enough for your help.

                        This alleged debt is in nearly the same situation as my Crapbot farce – the last year. I was honestly expecting mine to be farmed out to Ruthbish as there is obviously a relationship between the two, but so far it has gone elsewhere.

                        It is interesting that Crapbot had gone quiet for two years until the alleged debt moved into its last year before SB, and then they suddenly came to life, first with their own threats and then with equitable assignments. This is similar to what is happening here, and highly suggestive of what Niddy said earlier – that they are deliberately stepping up their effort before time runs out.

                        SnV's assessment of Ruthbish is spot on – although I doubt that they have purchased this alleged debt. I'm sure it is just an equitable assignment, because they only threaten to recommend to their client to take court action.

                        If the Dopey Little Creeps had any intention of taking court action, why have they not done so during the last five years? It doesn't make sense.

                        I'd be surprised if there was any problem here, although I never take anything for granted.

                          Had a reply from Ruthbridge this morning saying in an effort to amicably resolve the situation they're offering a 50% discount by no later than 19/10.

                          Failure to reply,they "may" carry out further investigations into financial circumstances with the possibility of legal action and propose looking into bankruptcy.Should their client proceed,they would serve a demand notice and after 21 days a petition would be served for the proceedings to take place 14 days later.

                          They go on to say they want to resolve it amicably and once funds are recieved they,where applicable,will update credit reference agencies.

                          Just to clarify,this alleged debt is not on my credit files,so why they say they will update them once it is settled i dont get...just another scare tactic i suppose,and with the SB date coming up theyre literally trying anything they can now.

                          Anyway,should i reply or leave them alone?

                            Is the amount of this alleged debt above the bankruptcy threshold?

                              It was for £6867.30.If you take a look at my original post it was car finance,gave the car back after a few months of having it.That was about 9 yrs ago.Last payment made Aug 07.Its SB'd in August 2013.Niddy had a look at paperwork they produced and said its unenforceable.

                                In that case, the threat of a Statutory Demand needs to be taken seriously. Especially if you own property or other assets which would make it profitable for a creditor to petition for your bankruptcy.

                                Statutory Demands are ridiculously cheap to issue, so there is every chance this may happen. The courts, however, detest the abuse of the Insolvency Rules by debt collectors who are only using Statutory Demands as a scare tactic, and who have no intention of going through with a bankruptcy petition. I have seen many cases of Statutory Demands being set aside with costs awarded.

                                If a Demand is issued, you will have 18 days to apply for it to be set aside using forms 6.4 and 6.5 (assuming you are in England or Wales). Here is the link to the official government site -

                                Ruthbish are probably blowing hot air, but cover your back just in case.
