    update is the bailiff did not come...my friend rang him a few times but went straight to voicemail. Least he can sleep easy for now.

        Shame - was looking forward to ripping them a new hole!!

                Just a little update...my friend rang me and said after trying to ring the bailiff whose name is Mr Lewis...silly me...I thought it was a lady...don't know why, anyways....my freind said that he left a message on the bailiffs answer machine..basically saying that he had paid the court fine/judgment in full.....and if the bailiff wanted more money he would have to supply the correct paperwork and go through the correct procedure. Also if he attempted to come to the house and start threatening to change the locks then my freind would call the police...on him. So.........

                this morning my friend said the bailiff rang and he was very very nice & polite and said that my freind had to pay that £275 as they were costs of collecting the judgment. My freind said that the court said that no further sums were owing....the bailiff when he first rang told my freind that he worked for the court..when my friend asked him clearly do you work for the court or for Marstons...he replied Marstons...and the court had instructed them.

                The end of the conversation was that the bailiff asked my friend to ring the court and they will confirm that he owes Marstons £275...my freind said ok whe will ring and find out and then get back to him.

                I said like fuck should you ring the court and find out...as far as you are concerned you have paid the debt off in full...and if this knob jockey wants the £275 he will have to fight for it properly. Lets see if this bailiff rings back to ask if my freind rang the court...I told him that he should say that yes he did ring the court and they advised him that it was in fact Marstons that owed my friend £275 and not the other way round and play him for a while then hang up LOL.....

                Will update if I hear anything more...which most likely I will...

                  My freind just rand and said that the bailiff called and advised him that he will come to his house this evening and if my freind wants to call the police he can...as he will come and execute the warrant today.

                  Oh lord what is going on? any help or advice Niddy on what to do now as I don't think this Mr Lewis is going to back down.

                    It might be worth getting your friend to ring the court just to check, if they had allowed costs to be taken.

                      As the fine has already been paid, the court fines office should have called Marstons to inform them.

                      Get your friend to call the Court Fines Officer to stop any further action.

                      Get the bugger's full name and check with the Ministry of Justice if the git really is a Certificated bailiff who works for the Marston Group of turds.

                      I believe that the threats that oaf has made may already amount to blackmail, but the trouble would be to get our inherently indolent plods to act on it.

                        With a Magistrates' Court the bailiffs will have agreed their fees with the Court Service.

                        In Magistrates' Court distraint, costs are NOT added on to the sum if it remains unpaid and the matter returns to court for further enforcement because the penalty due only includes the court costs and the court has no liability for any charges.

                        However, IN ALL CASES, if the debt is paid, without the costs, before any seizure has taken place the right to distrain ceases.

                        Tell your friend to inform the bailiff that tender has taken place and thus the levy process is ended.

                              So get your friend to check:

                              If you have searched the Register but are unable to find the certificated bailiff that you are looking for, please contact HM Courts & Tribunals Service Operations Team on 020 3334 6355 between 10am and 4pm. HM Courts & Tribunals Service Operations Team will search the Register for you and will be able to advise you of the county court that issued the bailiff's latest certificate. They are unable to advise you on any other matters.

                                I had the misfortune of dealing with Marstons for a client recently. If the fine wasn't paid to the court by the due date then the court can instruct the bailiff to collect on its behalf I'm afraid. Marstons website shows fees as £75 Compliance fee (i.e. for getting the job & handling the paperwork) and £200 Attendance fee (for turning up and making threats) even if the debtor is out. It's possible that the only way to stop it is to ask the court to contact Marstons and confirm that the debt was paid before time limit was up. Shockingly courts don't automatically tell bailiffs when a debt has been paid, but they will do if asked. If the fine was paid late then the bailiff is still due his fees. Your mate can register a complaint with the bailffs by emailing customer.care@marstongroup.co.uk . They won't put a stop on the visits while they investigate unless the complaint refers to the bailiff's conduct. So it's worth a try. But if the payment was made late to the court I haven't got any suggestions other than to ask them to extend the deadline for payment - which they are not obliged to do.

                                PS I should add that the bailiff can only take goods to cover the unpaid court fine not his fees.
