    She didn't formally overturn the Ombudsman's Decision (i.e. it wasn't re-written) because she hasn't the power to do that. But she did agree that it was flawed in some areas. Her report concluded that I should seek redress against the Mortgage Express for damages through the courts. That's the same thing as saying the Ombudsman got it wrong.

    That was good enough for me

    Mine was an odd case because the Ombudsman had upheld my complaint but got the comp/consequences wrong. But it wasn't a dissimilar situation to yours. The FOS has agreed that HSBC got it wrong (partially upheld your complaint) and says that the bank should refund you. But the FOS got the bit about removing your CRA default wrong. It's a subtle but important point. Without doubt you should fight your corner on this error of judgment.

    The Independent Assessor upheld my complaint. She advised me strongly to take formal legal advice on the consequences of the bank's (Mortgage Express) actions and my resulting financial loss and she itemised the precise issues. It was a clear message. I like the Independent Assessor

    I agree , it can't do any harm. It will be interesting to see what I get back from the Independant Assessor, it might give some insite to her thought processes.
