    Oh yes sent recorded delivery and hand delivered into the court as well! You can never be too careful.

    I've told the other half to call the court Monday and advise them were having letters from Philips even though the dec's gone in. I may just follow it up with a little letter too (i love my paper trails lol) Plus I'd rather deal with the court than those rude so and so's at Philips! I would have thought the court would have been on the ball when informing the bailiffs to lay off, after all I bet they're quick enough to instruct them!

    Well if anyone does try to come in they'll have to get past the dog first!

      and do write a wee letter of complaint, a wee threat to go to a newspaper is always good in these cases, you know poor innocent tax paying hard working upstanding citizens harassed by incompetant court staff and vicious bailiffs...............lovely!!!

        Yeah very true, we are!! lol Plus the court lost the first stat dec we sent them over a year ago, which is why were still in this situation Why should we be harassed with these threats when we've done nothing wrong? Well i've got the address of the Court Manager so I think I'll be drafting a letter to him asap.

          I've just typed a lovely reply, and the dog jumped on the keyboard and its gone! lol

          DO NOT PANIC - THE BAILIFFS CANNOT FORCE ENTRY! TRUST ME!

          They would have to go back to the court and get a warrant (only 10 were issued all of last year). These are almost never given, so they're not going to be given here are they.

          If the dear fellow does return, either go outside, locking the door behind you. Do not kick him where it hurts, but DO ask to see his certification - make a note of his name, the court where he was certificated and obviously the company he is working for.

          IF you get this information (I doubt they will show up) post up again and pm ME!!!!!

          Also ask to see the Distress Warrant. He does not have to have this with him, but he does have to tell you where and hen you can inspect it. Often they refuse to do this. Why would they if a valid DW existed? Possibly because they don't have one, and they know they have to go back to the court who won't give them one.

          This is called Criminal Misrepresentation of Power - again post up and pm me for help with a complaint.

          Just remember, the bailiff has no right to force entry. Don't leave your car immediately outside as an invitiation to levy upon - no point inviting trouble.

          All will be fine - he is just like a DCA claiming all sorts but actually pretty impotent.

          You should also, of course, inform him the court have put things on hold for 48 days while you file another Statutory Declaration. Hopefully you've a copy of it to show him. He will, correctly, say he's allowed to enforce while it is being processed, but he knows, like you do, he'd be very very stupid to do so.

              Thanks BBoo, i thought there letters may have been more hot air than anything else but i wanted to play safe and ask as they're court appointed bailiffs.

              I took a few copies of the stat dec so if they do show up i can always press one to the window i'll be peering out of, or depending on how i feel on the day go out, lock the door behind me and give him one (the stat dec obviously, not the kick in the balls you said i couldn't give him )

              I've made a note of what i'll need to find out if he turns up so If anything happens I'll PM you but hopefully a call to the court Monday should help sort it out.
